Togo: two billion FCFA fine for the operator Togo Cellulaire

The regulatory authority for electronic communications and posts imposed a fine of more than 2 billion CFA francs on Togo Cellulaire for serious breach of its obligation.

Togo Cellulaire, owned by the Agou holding company (Axian group in Togo), will have to pay the equivalent of 2% of its turnover for the 2021 financial year.

It was at the end of a procedure initiated 18 months ago, followed by an adversarial public hearing, that the sanction fell.

In November 2020, Togo Cellulaire, one of the country's telephone operators, was given formal notice to do everything possible to guarantee the quality and availability of services in accordance with its specifications. 

But the situation has deteriorated sharply, indicates the regulatory authority in its press release, despite “

reminders and alerts

”.

In addition to the low investment in infrastructure, Arcep criticizes Togo Cellulaire for voluntarily and daily interrupting its services in many remote localities of the country during specific time slots, with the sole aim of reducing its operating costs.

The accumulation of these interruptions can reach 25 days of unavailability in a month.

Togo Cellulaire will therefore have to pay a heavy fine of more than 2.3 billion CFA francs and will be obliged to put an end to these breaches within six months, under penalty of new sanctions.

The operator has not yet reacted officially to these sanctions.
