Controversial back to school between smoke
Judicial victory for the residents of Delicias who have been fighting for months against a ghost kitchen located next to the Miguel de Unamuno school.
The Justice now agrees with them and
annuls the license
under which these kitchens operate with three key arguments: they lack an environmental impact report, a legal report and they fail to comply with urban planning regulations.
The judge considers that it is an industrial business not comparable to a traditional hospitality business -which is the license currently used- and that the birth of new types of economic activities should not be left
out of municipal control
.
The sentence also highlights that the installation of this type of business implies
some damage to the neighbors
derived from cleaning, waste treatment, noise pollution and smoke emissions.
The judge adds that in this case, being next to a public school, "the duty of municipal surveillance" should be extreme.
After the court ruling, the families of the Miguel de Unamuno school and the residents of Delicias
trust that the City Council will not appeal the sentence
.
As they point out, the kitchens on Calle Alejandro Ferrant do not adapt to the new regulations on ghost kitchens that the Consistory is going to approve because they are located in a block that, by zonal norm, would no longer accept the installation of industrial businesses in spaces greater than 350 meters squares.
The parents of the school center also recall that the José Luis Martínez-Almeida City Council has launched an initiative
to improve school environments
and make them safer in which it will invest 15 million euros.
Quite the opposite of what is currently happening in this school, where
the sidewalk where the children run is full of riders
.
«The way to school is dangerous with motorcycles circulating on the sidewalk and on the road in the opposite direction.
We cannot be calm, ”censors Noelia Cabezas, mother of two children from the center.
