A man accused his ex-wife of seizing an amount of 300,000 dirhams he had handed over to her as a deposit refunded during the marital relationship, but she did not return the amount, while the Abu Dhabi Family and Civil and Administrative Claims Court rejected the case, after the defendant denied the accusation and took the decisive oath.

The details of the case refer to a man filing a lawsuit against his ex-wife, asking her to oblige her to return the amount of 300,000 dirhams, imprisoned by her unlawfully, noting that during the marital relationship he handed the amount to her as a deposit, and when he asked her to return it, she promised him to return it in monthly installments of 5,000 dirhams, but she did not fulfill her promise, while the defendant submitted a reply memorandum in which she pleaded not to hear the case after three years, and the case was rejected.

During the consideration of the case, the plaintiff submitted a commentary note, at the conclusion of which he originally requested, before deciding on the issue of the case, to refer the case for investigation, so that he could present witnesses, and prove by all means of proof that the defendant delivered the amount of the claim as a refundable deposit, and that she did not return the amount to date, and in precaution, the oath was directed crucial to her.

The court asked the plaintiff whether he had brought the witnesses or not, so he decided not to bring them, and asked for the decisive oath to be given to the defendant. It is her, and my debt is not occupied by him with the aforementioned amount, and God is a witness to what I say.”
