Spain: after humiliating a homeless, a youtuber sentenced to no longer publish videos

In Spain, this is a first, justice has just condemned a youtubeur to no longer publish on the social network after having humiliated a homeless person in a video.

Justice has therefore decided on an unprecedented sanction in Spain.

This is a first in the country, the Spanish Supreme Court has just confirmed the conviction of the Barcelona youtuber ReSet: he is therefore prohibited from posting videos on his profile or creating another for five years.

Justice is based on a usual judgment "

 the prohibition to return to the scene of the offense

 " and, in this case, applies it to an unusual place: this social network on which the Barcelonan had more than a million subscribers.

In addition, he is also sentenced to 15 months suspended prison sentence and to pay 20,000 euros to the homeless person whom he humiliated.

Oreos stuffed… with toothpaste

The judges also underline the vexatious nature of the video.

It must be said that this video had outraged the country at the time, in January 2017. We saw this young youtubeur then 19 years old trapping Oreos cookies by stuffing them with toothpaste and then offering them to a homeless person in the streets of Barcelona.

The video ended with the young man commenting jokingly on 

the “help

 ” provided to the beggar who “

 does not have to brush his teeth since he is poor

 ”.

His victim, she suffered from stomachaches, vomiting and above all was very scared underline the judges who also recall that this type of offense "

The youtuber not ready to give up social networks

Shortly after the fact, the youtubeur seemed at least aware of the risks he was running since he had tried to buy his victim's silence with 300 euros.

Then he deleted the video, for which he earned more than 2,000 euros thanks to the thousands of clicks generated.

But quickly, during the trial, he mainly blamed the judges and the media for having ended his " 

career

 " as a youtuber when he had dropped out of high school to devote himself completely to it.

For him, it was just a joke.

And despite this verdict, he does not seem ready to give up on social networks.

In a message posted on his Instagram account on Thursday, he says he is willing to pay his debt to society and explains that he has changed and matured, before inviting his subscribers to watch his videos, this time on his new account. .. TikTok.
