The victim said in the investigations of the Public Prosecution that they were eating a common meal, and there was a dispute between them over the amount of food, so the accused insulted him with an obscene word, which prompted him to respond to him, and while he was leaving the room, the accused followed him and stabbed him in the stomach with a knife, hitting him and knocking him to the ground.

While the accused admitted in the investigations of the Public Prosecution of his crime, attributing this to a temporary dispute between them and that the victim had assaulted him, which led him to stab him, not intentionally killing him or even attempting to do so, and that he incurred the expenses of his treatment until he left the country, and they were reconciled.

In the ruling’s merits, the court stated that the case papers were devoid of what indicates the presence of the accused’s intent to kill, stressing that his use of a knife to assault the victim does not necessarily mean the presence of the criminal intent to kill, especially since if it was intentional, he would have finished off the victim after his fall and did not He leaves him with nothing but a lifeless corpse, but the reality of the situation is that he only intended to hit and harm him.

She confirmed her confidence in the evidence in the case, in addition to the defendant's confession in the investigations that he assaulted the victim by beating, without intending to kill or attempt to kill him. .
