The Constitutional Court has suspended the disciplinary effect of Rep. Kim Ki-hyeon, who received the disciplinary action of 'suspending attendance at the National Assembly for 30 days' after occupying the chair of the Legislative and Judiciary Committee in the 'complete inspection' phase.



The Constitutional Court yesterday (3rd) accepted the application for an injunction to suspend the effect of disciplinary action against the Speaker of the National Assembly with the unanimous opinion of all the judges.



The court ruled, "The most important and essential thing for members of the National Assembly is the power to legislate, and this right includes the right to deliberate and vote on bills."



"If the effect of the suspension of attendance against Rep. Kim remains in effect, he will be unable to attend all meetings of the National Assembly regardless of the session during the 30-day suspension period, effectively suspending his activities as a member of the National Assembly." It will inflict serious damage that is difficult to recover from the right to deliberate and vote on bills, which is an important and essential authority.”



"If the request for a dispute over authority is cited in the final decision after dismissing the provisional disposition, there will be no way to recover the right to deliberate and vote on the bill that was infringed during the suspension of attendance because the execution of the disciplinary measure against the applicant has already ended," he said. Previously, the Democratic Party of Korea submitted a disciplinary plan for Rep. Kim on the 4th of last month on the basis of Article 155 of the National Assembly Act, which allows lawmakers to be disciplined only by the resolution of the plenary session without going through a review by the special committee on ethics in the National Assembly if they occupy the chairperson or chairperson's seat.



The National Assembly plenary session passed this disciplinary bill on the 20th of the same month with 150 votes in favor, 109 against, and 9 abstentions.



In response, Rep. Kim filed a complaint with the Constitutional Court on the power dispute against the Speaker of the National Assembly on the 24th of last month, claiming that "the National Assembly Act, which made the disciplinary action for occupying the chairperson's seat directly referred to the plenary session without going through the special ethics committee, is unconstitutional." .
