On the night of Saturday to Sunday, in Revel (Haute-Garonne), a man entered the room of a young mother, his face hidden by a garbage bag before miming the sexual act.
The perpetrator was arrested by the gendarmes in the process and judged immediate appearance in the Toulouse court
"Alcoholic, immature", the man, deemed dangerous, was sentenced to thirty months' imprisonment, twelve of which are closed.
His name will be placed on the Sex Offender Registry.
"It's 5 a.m., you're sleeping peacefully.
Your baby starts crying, you wake up.
Above you, two eyes stick out of a garbage bag.
It is with these words that Brice Zanin, lawyer for the civil party, describes his client's nightmare.
The assault occurred on the night of Saturday May 21 to Sunday 22, in Revel, Haute-Garonne.
The victim, a 23-year-old mother, had the fear of her life when she discovered a man in her bed, straddling her.
His face masked by a plastic bag, he held her arms, mimed the sexual act and slipped to her: "Don't shout, I don't mean you any harm, we know each other..." Panicked, and while her baby was screaming right next to her, she managed to keep calm and found the courage to talk to him.
The scene lasted for several minutes.
The man, very alcoholic, left and then returned.
When he finally left after half an hour, the young woman called the gendarmerie.
The suspect was caught nearby.
“I wish he would never go out”
At the hearing this Tuesday, at the Toulouse Criminal Court, the debates were heated.
Faced with President Myriam Viargues, the 36-year-old man, in tears, failed to explain his gesture.
Described as “immature, alcoholic, and of somewhat short intelligence” by the expert psychiatrist, he explained that he “wanted to talk to her”.
Because the two know each other – from afar, through common relations –, even if the young woman says that she has not met him for at least two years and has never accepted his repeated friend requests on social networks.
The young mother, upset, testified at the bar that her little girl has been very agitated since the episode and that she herself remains frightened.
“I wish he would never come out,” she said.
His lawyer described the man as a predator: “He tracked her!
[…] He drinks alcohol to give himself wings!
He didn't drink more than necessary, he drank just enough to dare.
Prosecutor Tristan Lamouille described the facts as "clearly premeditated" committed by an "extremely disturbing" character.
Duty of care
The defense tried to dismantle the premeditation.
"He's just a poor guy!"
protested his lawyer Cécile Bordes-Escaich.
If he put a bag over his head, it's because he thinks he's too ugly!
“She denounced” requisitions which do not make sense “for a situation” pathetic as possible “.
But the judges followed the prosecution's requisitions and sentenced the man to 30 months in prison, including one year, with continued detention.
The decision is accompanied by an obligation of care and a ban on being in a wide area around the victim's home.
His name will also be placed on the sex offender files.
