A year after its broadcast, the

Rocío phenomenon, telling the truth to stay alive

, is still just as critical.

And even though the scenario is different in many aspects.

Eight months after the Social Court number 42 of Madrid declared the

dismissal

of Antonio David Flores "null for violation of his right to honour" -the day after the docuseries of his ex-wife,

Rocío Carrasco

, premiered- , the Court Superior Court of Justice of Madrid (TSJM)

dismisses the appeal

filed by La Fábrica de la Tele and estimates, "in part, the appeal filed by the procedural representation of Mr. Antonio David Flores Carrasco, for the sole purpose of

rectify the amount of compensation

for non-pecuniary damage amounting to

120,000 euros",

according to the sentence dated April 29, which LOC has been able to access.


EL MUNDO already had access to the full sentence of the Social Court number 42 of Madrid which, dated September 20, decreed that "the dismissal of the worker is null for

violation of his fundamental right to honor,

condemning the defendant [the production company La Fábrica de la Tele] to the payment of wages not received until the date on which the temporary contract had ended -32,361 euros- (...) as well as additional

compensation

for damages caused by the violation of his right to honor in the amount of 50,000 euros".

Rocío Carrasco's statements in the docuseries, in which she accused Antonio David Flores of

"psychological abuse",

then caused a tsunami in the world of the heart that even politics jumped into the ring.

The Minister of Equality,

Irene Montero, celebrated the broadcast of the program on her Twitter account while the program was still broadcasting, to name just one example.

Now, "the company La Fábrica de la Tele is condemned to pay an additional compensation of 50,000 euros" and

reflects again

on what a year ago obtained the media, social and political focus of an entire country.


"Here the 'exceptio veritatis' cannot be applied," says the ruling.

or with manifest contempt for the veracity of the news, substituting an objective truth, empirically verifiable, for

a subjective truth.


To the collaborators of the program who commented between episodes, Justice says: "The communication medium and the presenters and collaborators of the program are

also perfectly required to respect good faith.

Since what was communicated is not supported, therefore, in truthful information, but rather in the subjective, partial and self-interested account of Ms. Rocío Carrasco Mohedano, taking into account

the provisional dismissal of the criminal case

brought at the request of Ms. Rocío Carrasco Mohedano against Mr. Antonio David Flores Carrasco (Proven Fact Thirteenth),

the protection of the right to free communication is reduced

and immediately confronted with the preservation of the right to honor of the person to whom the content of the communication refers and thus, the repercussion of the statements subject to examination on the right to honor and reputation of Mr. Antonio David Flores Carrasco It cannot be denied, especially since it is stated in the proceedings that
