A wealthy 47-year-old businessman has been acquitted by a Majadahonda judge after being accused of

drugging and sexually assaulting a 25-year-old

sugar baby

attractive young woman who has a relationship with an older person in exchange for gifts

)

, during a threesome in a party held in a chalet in the west of the region at the end of last year.

The judge who filed the complaint does not give credibility to the young woman's testimony and maintains that there are numerous inconsistencies in her account.

The defendant

met a 24-year-old girl on Tinder

who told him that she was actually a

sugar baby

and that she could meet him whenever they wanted in exchange for luxurious gifts such as Louis Vuitton bags or Dior necklaces.

The man accepted and they started having sex.

This woman told him that she knew another

sugar

that she wanted to see.

The businessman accepted and organized a barbecue in his chalet to meet his friend.

At the party the second girl pointed out to the first that she had liked the businessman and that she wanted him to support her as well.

That night a threesome began between the defendant and the two women.

she could only kiss him and that she should stop when she asked.

However, the friend goes ahead with the sexual relationship and faced with this situation, the first one, angry, left.

The businessman ran after her and asked her to come back.

This she demanded that he throw out the second

The man did and sent her into another room.

The next morning the guest exposed her discomfort to her friend and she left the house and two days later she reported that she had been raped at the party by the businessman after being drugged.

The victim had also tested positive for Benzodiazepines.

The lawyer Beatriz Uriarte, an expert in gender violence and sexual crimes at the head of the criminal procedure area in the

criminal law firm Ospina Abogados,

defended the businessman.

The case fell to the Investigating Court number 8 of Majadahonda.

Uriarte maintained from the beginning that the sexual relations were fully consensual and that no one drugged the complainant, providing transcripts of various WhatsApp conversations, which revealed, among other extremes,

the collusion between the two women prior to the night mentioned .

and having a good time, even planning to "...fuck him or have a threesome with us."

The messages were ratified in her statement by one of those involved, indicating that "the three went up to a bedroom, lay down on the bed, and the three began to have consensual sexual relations."

The witness added that "at no time was her friend sexually assaulted, that

she did everything freely, consciously and voluntarily, that before that the three of them talked about the limits of the sexual relationship",

the complainant leaving by herself to another room when she considered that those limits were crossed and her friend had a complete sexual relationship with the investigated.

But in addition, the criminal lawyer reeled off

the toxicological report provided by the complainant,

in which the presence in the complainant's blood of Lamotrigine, a drug used for epilepsy and bipolar disorder, pathologies suffered by the victim, Clobazam , from the group of benzodiazepines, indicated for the treatment of anxiety and coadjuvant of epilepsy, naproxneo, an anti-inflammatory, and finally pseudoephedrine, with decongestant properties for nasal congestion and rhinitis.

The defense was able to demonstrate "that it was

the medication itself taken (by the complainant) that gave a positive result for said substance in the blood

, and in no case any other substance that the investigated party could have used to obtain the consent of the victim at the time of being able to have non-consensual sexual relations with her," according to the filing order.

The judge in charge of the case, assessing all the circumstances and peripheral elements surrounding the facts, stated that she was faced with a case of contradictory versions in which "

there are no corroborating elements or objective or subjective

, main or peripheral, direct or indirect, or even circumstantial of the version of the facts offered by the complainant, about alleged sexual relations without consent, induced by an alleged consumption of toxins, "according to the order.

The magistrate adds that if the account of the accused supported by the witnesses has consistency, especially that of the woman who witnessed the sexual relations directly and in person, "who stated that the complainant gave her consent to them at all times, and did not I was neither drugged nor dizzy when the events occurred.

The order adduces these reasons to agree to the file and dismissal of the proceedings, describing that "

in the DNA report there is no semen or genetic material of the investigated

, and in short, the concurrence of the objective and subjective elements required to be in the presence of a crime of sexual abuse without consent between adults is not appreciated". Finally, the magistrate points out that "we can even find ourselves in the presence of a spurious spirit in the initial complaint, given that from
