Miguel Abellán, managing director of the Center for Bullfighting Affairs of the Community of Madrid, is the subject of

the criminal complaint filed in the Madrid courts

for the alleged crimes of prevarication and bribery.

Prevarication for the drafting of the specifications for the exploitation of Las Ventas and bribery for participating in the plot of the collection of commissions in the Bullfighting Circuits of the Community of Madrid (Fiesta del Toro) in which

Miguel Martín, his " right hand"

and coordinator of the bullfighting schools of the Community of Madrid.

The complaint was filed on April 11 by the Association of Fighting Bullfighting Professionals, headed by José Montes, the man who, on behalf of the company Gestión de Toros Las Mancha SL

, challenged and paralyzed

the operating specifications of the Monumental de las Ventas before the Court of Public Procurement, which ruled in his favor on three grounds: "The solvency requirements, the valuation criteria subject to value judgments and the calculation of the estimated value of the contract".

The new legal action of Montes indicates the first two annulled points of the aforementioned "

those that demonstrate bad faith

and knowledge of their illegality at the time of writing the aforementioned statement."

According to the text of the complaint, the omission of the 2021 season in which technical solvency requirements was not only not in accordance with the law -which marks the last three years-, but intentional "because a calculation error is impossible".

"We find the argument of the Center for Bullfighting Affairs of the Community of Madrid in its allegations to the appeal filed, that excluding the year 2021 from the reference period to prove solvency is due to the fact that in the year 2021 there has hardly been any bullfighting activity by the health reasons that everyone knows about Covid 19, which the Contracting Court of the Community of Madrid had no problem labeling as illogical and surreal, since the year that had truly suffered a historical decline in bullfighting was the year 2020".

And the text concludes:

reaching an activity of 70% compared to 2019

and predecessor of the pandemic". Always according to the complaint, "this maneuver produces a limitation of the competition to all the companies that have developed their activity intensely in the year 2021".

Montes' new legal action also involves current Las Ventas businessmen Rafael García Garrido and Simón Casas (Bernard Domb Cazes in the lawsuit), whom he points to as

"friends" of Miguel Abellán and "necessary cooperators

. "

Abellán, says the complainant, "leaves them a free path", "with knowledge of the injustice" with the sole purpose of benefiting them, "so that these and their joint venture of companies are, without any competition, the next businessmen of the Plaza de Las Ventas ".

In the eyes of the plaintiff "they have jointly carried out the drafting of the specifications that govern the new award of the contract for the operation of the Las Ventas bullring" and points out as

"manifest evidence of complicity"

the permissiveness of Miguel Abellán with the sale of tickets for young people and retirees for all the bullfighting shows of the year 2022 "of which there is no a priori guarantee that the company that has proceeded to sell them can be organizers of them" whenever the validity of the contract of the current winning company ends on June 5.

The text of the complaint also points to another "illegality": "the administrative document legitimized its editor and now defendant Mr. Miguel Abellán to make technical reports" of the evaluation criterion subject to value judgment "so that the Contracting Committee would score this criterion of offers,

grossly contravening what is marked

in article 326.5 of Law 9/2017: 'in no case may representative public positions form part of the Contracting Committees or issue reports on the evaluation of the offers,'" he says. the complaint document.

Regarding the crime of bribery, the complaint points to Miguel Martín, coordinator of the bullfighting schools of the Center for Bullfighting Affairs of the Community of Madrid "and right-hand man of Mr. Miguel Abellán."

And he cites the interviews published in EL MUNDO in which the ranchers acknowledge "having to

pay a 4% commission to them for choosing the animals

from their farms to be fought in bullfights and bullfights as a result of the collaboration agreement signed between the Center for Bullfighting Affairs and the Fundación Toro de Lidia".

And he expands even further: "These illicit commissions are presumably charged by the defendant when he himself chooses the farms whose owner

is willing to deliver money B

in exchange for the person responsible for deciding which are the herds whose cattle would be bought so that they would be fought in the aforementioned bullfights," he says.

According to the complaint, "the defendant offers to pay them for their animals a much higher price than the market price so that it

does not imply a decrease in their

price expectations, as will be proven if the proposed proof of comparison of invoices is accepted. sale of cattle from other festivities other than the ranchers who sold their cattle for the festivities of the aforementioned agreement of the CAM-Fundación Toro de Lidia".
