The Abu Dhabi Court for Family and Civil and Administrative Litigation ruled obligating a young man to pay the last amount of 30,000 dirhams that the plaintiff had mistakenly transferred to the account of the convict, and the latter refused to return them.

In the details, a young man filed a lawsuit against another requesting that he be obligated to pay him an amount of 30 thousand dirhams with obligating him to pay the expenses and fees, indicating that he transferred this amount to the defendant by mistake and that the latter did not return it to him and attached copies of account statements, a misdemeanor referral order and a copy of a court ruling Pictures and other documents.

 During the hearing of the case, the defendant did not attend, so the supervising judge decided to take the complementary oath to the plaintiff, so he swore it in the form “I swear by Almighty God that I have transferred an amount of 30 thousand dirhams to the defendant by mistake and that the defendant has no relationship between me and him that calls for transferring the amount to him and that he did not return this amount to me or Part of it and that his debt is still occupied for me with the full amount of this amount, and God is a witness to what I say.”

For its part, the court confirmed, in the merits of its ruling, that the decision, according to the Evidence Law in Civil and Commercial Transactions, is that the plaintiff must prove his right and the defendant has the right to deny it, noting that the attached penal judgment is a presumption of the validity of what the plaintiff claims that he transferred an amount of 30 thousand dirhams to the defendant. By mistake and the defendant did not return this amount to the plaintiff, in addition to completing the evidence by directing the complementary oath that the plaintiff swore, and then the court proves the validity of the plaintiff transferring an amount of 30 thousand dirhams to the defendant by mistake and not returning the amount to the plaintiff by the defendant as the court cannot Except for the judiciary to the plaintiff with the amount claimed, and the court ruled to obligate the defendant to return to the plaintiff an amount of 30 thousand dirhams and obligated the defendant to pay fees and expenses.
