The two minors arrested for the crime of Samuel Luiz on July 3, 2021 on the promenade of

La Coruña

have been sentenced for their participation in the events and are currently serving an internment sentence in a closed system juvenile center .

Both adolescents have been sentenced at the beginning of this month of April without the need to hold a trial, since there was a prior agreement between the parties that led to a final sentence issued with the consent of the minors themselves.

Both the

Juvenile Court of La Coruña

and the

Prosecutor

's Office officially confirm that there is such a sentence and that it is already firm, but they rule out providing more details of it due to the special protection that both defendants have due to their status as minors.

The

Superior Court of Xustiza de Galicia

(TSXG) also confirms that "at this time" both are "fulfilling a measure of internment in a closed regime", ruling out providing more data.

Since both were investigated for a crime of homicide, everything indicates that the conviction was for that crime, but that information has not been provided either.

This sentence came

in extremis

to avoid the supervised release of both, since the two adolescents were, as a preventive measure, in a closed regime center for minors since a week after the crime, on July 11, 2021, and the Law of the Minor limits the maximum time of this precautionary measure to nine months before the minor is judged.

Specifically, the Organic Law 8/2006 regulating the criminal responsibility of minors establishes that the maximum time of the internment precautionary measure will be six months, and may be extended, at the request of the Public Prosecutor, after hearing the minor's lawyer and by reasoned order, for another three months maximum.

In this case, the measure was extended up to the legal maximum, but, if the trial had not been held, they would have been released this Monday, April 11.

Finally, just a few days before, at the beginning of April, this agreement was reached and the teenagers are firmly condemned.

In addition, this sentence is added to one of them to a previous one, since she was already on probation for another crime when Samuel's crime occurred and he was arrested.

In the judicial investigation phase

In this case there are seven people investigated for a crime of homicide and the other five are awaiting trial, with the case still in the investigation phase.

Specifically, there are three adults in pretrial detention and two more people on pretrial release with the obligation to appear regularly in court.

All are accused of participating in the brutal group beating of the young Samuel, who was 23 years old, although one of them, the only girl investigated, only for her role as a cover-up.

The seven are accused of the same facts, but they will be tried in two different procedures, since the two minors were submitted to the specific jurisdiction due to their age.

In the case of adults, the judicial investigation is pending only one last diligence.

The Court of Instruction number 8 of La Coruña has sent a rogatory commission to the United States in order to have access to data deleted from different social networks by the alleged perpetrators of the crime.

It is considered fundamental evidence given the suspicion that those under investigation were able to communicate on this matter after the events and then deleted the messages.

Samuel Luiz was murdered in the early hours of July 3 when he was leaving a nightlife venue on the seafront in La Coruña as a result of a group beating in which he received more than 40 blows and a bottle.

From the first moment, one of the axes of the investigation was to determine the motivation of the crime.

Witnesses report that he was attacked shouting "faggot" and "fucking fagot", so the accusations ask that the seven investigated are also tried for a hate crime because they understand that it is a homophobic crime.

Different information suggests that Samuel and a friend who was with him at the time of the crime had already argued with his aggressors two hours before the attack and that one of the aggressors, the alleged perpetrator of the portal hit, was able to meet in a park with a group of friends hours after the crime and in the meeting he would have made homophobic insults.
