Subjecting private public interest entities in Dubai to the supervision of the Community Development Authority

His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, in his capacity as Ruler of the Emirate of Dubai, issued a decree subjecting private entities, of public interest, established pursuant to legislation, to the supervision and control of the Community Development Authority in Dubai.

According to the decree, the private entities of public interest that the authority supervises and controls are the institutions, centers and entities established by law or decree of His Highness the Ruler of Dubai, as a non-governmental, non-profit organization that achieves the public benefit for the groups it targets.

The Director General of the Authority, by virtue of a decision issued by him, determines the scope of supervision and control over private entities covered by the provisions of the decree, provided that several criteria are taken into account when determining the scope, including: oversight of the entity’s financial resources, verification of its sources of revenue, aspects of disbursement of its expenditures, and the extent to which this is compatible with the purposes for which it was established, obligating the entity to keep its financial and administrative data and records, determining the method of their preservation, the period of retention, enabling the authority to view them, the entity’s statute, and all internal regulations and instructions regulating its work, and ensuring the extent of its commitment to transparency in providing access to these data from The competent government agencies, and obligating the entity to appoint an external auditor to audit its accounts.

The standards also include the issuance of annual financial statements, which include detailed data on revenues and expenditures, to enable the authority to review the periodic reports issued by the auditor, view the records of activities practiced by the entity, its programs and initiatives, follow up on the extent to which it has achieved its objectives, the purpose of its establishment, and verify the data of the entity. Its founding persons, its management supervisors, and its employees.

The decree stipulated the necessity for private entities to abide by its provisions and the decisions issued under it, to cooperate fully with the authority, its employees and those authorized by it, and to enable them to exercise their powers, provided that the director general of the authority should take the necessary measures and measures against the entity that does not comply with the provisions of the decree and the decisions issued pursuant thereto, including imposing The penalties established under the Dubai Civil Establishments Law No. (12) of 2017, and a recommendation to the competent authority to repeal, dissolve and liquidate the legislation creating or regulating this entity.

The decree obligated the competent government agencies to cooperate fully with the authority, and to provide the data, information, documents and statistics that it requests and deems necessary to enable it to perform the tasks and powers entrusted to it, under the law regulating private establishments in Dubai, and the decree and decisions issued thereunder.
