As legal sources advance to EL MUNDO, the Fourth Section of the Contentious-Administrative Chamber has estimated the appeals filed by the Association of Prosecutors (AF) and the prosecutor of the Chamber

against the appointment of

Eduardo Esteban

as Prosecutor of the Juvenile Coordinating Chamber.

The decision of the High Court represents a severe setback to the controversial appointment policy carried out by Delgado, who has undisguisedly elevated his former colleagues from the minority

Progressive Union of Prosecutors (UPF)

to the generalship of the Prosecutor's Office, that is, the Board of Chamber Prosecutors.

The appointment of Eduardo Esteban was contested by the AF and prosecutor De la Rosa, considering that the appointment was not sufficiently motivated and that the aforementioned appointment was arbitrary as there was another candidate - the plaintiff - who enjoyed greater specialization in the matter. .

The difference between Esteban and De la Rosa, in addition to specializing in minors, was that the former is a member of UPF (the association to which the attorney general belonged until she was appointed Minister of Justice) and the latter of the AF.

In the proposal that the attorney general submitted to the Council of Ministers to approve Esteban's appointment, Delgado highlighted the proven management capacity of the UPF prosecutor "to generate positive synergies in a coordination position at the state level" when he was chief prosecutor from Madrid.

In addition, he alluded to "his well-known capacity for motivation and coordination, his human quality, positive, conciliatory and cohesive attitude, and enormous common sense."

The Chamber appreciates a manifest lack of motivation in the controversial appointment and proceeds to declare null Royal Decree 212/2021, of March 30, of the Council of Ministers, where Esteban was appointed as coordinator of Minors at the request of Delgado.

Now, the attorney general must again put out to tender the position of prosecutor of the Juvenile Court.

The ruling will be notified this Tuesday, although the sentences will be announced in the coming days, legal sources indicate.
