Al-Ain Court of First Instance obligated, accused of stealing and burning a car, to pay the owner of the car 100,000 dirhams in compensation for the material and moral damages he sustained.

In the details, a young man filed a lawsuit against another student obliging him to pay compensation in the amount of 200,000 dirhams, noting that the defendant stole his vehicle, burned it and was completely destroyed, and sold it as scrap.

The court stated in the rationale for the ruling, that the evidence from the papers is that the damage to the vehicle is the fault of the defendant who stole it, and he was convicted under a final criminal judgment, which with this judgment has gained the force of the res judicata, and it is a necessary chapter in the occurrence of the error and attributed to Its perpetrator - the defendant - and then the court refrains from re-examining the availability of the elements of tort liability, but its role is limited to estimating the value of compensation.

She pointed out that the defendant's mistake is proven by stealing the vehicle and burning it, which led to its complete destruction, and then it is established for the court that the vehicle was damaged as a result of what the defendant had committed and became doomed after being robbed, pointing out that the plaintiff submitted three quotations for the vehicle subject of the theft.

The court confirmed that the defendant’s error was established in the manner mentioned above, and it resulted in moral damage represented in the plaintiff’s feeling psychological pain and depriving him of using the vehicle as a result of the defendant’s action, and there was a causal relationship between the error and the damage, so the defendant is legally obligated to compensate the plaintiff for that damage The court estimated the moral compensation in the amount of 36,000 dirhams as Jaber’s compensation for all the damages incurred by him.
