Judgments issued by Dubai criminal courts in these cases ranged between acquittal and five years in prison for the defendants.

"Emirates Today" monitored a number of cases considered by the Dubai Criminal Court in various cases, in which the victims were children under the age of 14, who committed the crime of "indecent assault under duress" due to the absence of family oversight, according to the adaptation of the Public Prosecution in Dubai to the charges that were attributed to actors.

According to the facts of those cases, the children whose cases were considered by the court were subjected to physical harassment, touching sensitive parts of their bodies, kissing and cuddling them, or making them touch the bodies of the harassers, even if the crimes committed against them did not reach the limit of sexual intercourse with a girl or sodomy with a child.

All of these crimes, according to the Dubai Public Prosecution’s referral order, were committed by perpetrators belonging to Asian countries between the ages of 22 and 30, as a result of the accused’s exploitation of the victim’s being alone, which called him to seclude himself and harm him, to satisfy his sexual desires.

Dubai Appeals Judge Saeed bin Sarm said that “several crimes in which the victims were children occurred this year, and their causes were united in the absence of families’ supervision of their children,” as evidenced by a number of facts, including “an Indonesian maid who violated the honor of her employer’s child, due to the absence of parental oversight.” And an Asian man teaching a child religious lessons in Dubai, also violated his offer due to the lack of censorship, and his seclusion of the victim.”

"Unfortunately, families place their full confidence in a worker they have, such as a driver, a farmer, or even a maid, and the like," he added.

This was supported by the head of the Family and Juvenile Prosecution Office in Dubai, Counselor Muhammad Rostom, who saw that “family neglect of the child leads to serious consequences, up to the point where the child is exposed to a crime,” stressing that in each of them heedless of the child may be subjected to abuse, and not leave him alone either. In a shopping center or in a park or with the driver, and prevent him from going out into the street alone, provided that the monitoring is not closely, as parents must compel their supervision from a distance, continuing, “especially since the child is inexperienced in life and types of people.”

The last of these crimes resulted in the death of the child Musa, on the morning of the first day of Eid al-Adha last, after a young man sexually assaulted him in the bathroom of a place of worship in Al Qusais and then killed him by placing his hand hard on his mouth to prevent him from screaming.

And "Emirates Today", through its follow-up to these types of cases, noted that "the victim child often does not inform his family about the incident, because of his fear, but the parents' knowledge of this is after they notice the child crying and not being able to sleep, or feeling pain as a result of some of the accused. By holding sensitive parts of the victims’ bodies, several investigations have concluded that these defendants are taking advantage of the child’s helplessness, who is not able to defend himself, speak about it, or know that this act is wrong.

message to mom

A child, no more than 12 years old, wrote a letter to her mother, because she was unable to talk about the incident as a result of her bad psychological state - in which she asked to deport the accused who works for them because she did not want to watch him, as he inclined to indecently assault her more than once, and when her mother asked her about her reluctance to She was told orally since the incident, she told her that she was afraid, and the Dubai Criminal Court sentenced the accused to three years in prison with deportation from the state.

In another incident, which took place in a commercial market, in the massage parlour, accompanied the family of their 14-year-old girl, and while the parents were busy checking the equipment, the seller approached the girl and began to feel parts of her body and put pressure on her, and every time she tried to escape from him, she failed in That, and upon reaching the house, the victim was crying, shocked and afraid, so her mother asked her about the reason for that, and she replied that she was in pain because the accused seller held part of her body, which was punished by imprisonment for a year with his deportation from the state.

Judgments issued by Dubai criminal courts this year in these cases ranged between acquittal and imprisonment for five years against the defendants, and the defendants' methods varied between taking down the child's clothes, sticking to him, kissing him and feeling his body.

Most of these crimes occurred in elevators and school buses or from sellers, and from workers who came to the house for the needs of their parents, such as maintenance workers and others.

baby crying

Among those crimes was a Swedish girl who led the maintenance worker to the roof of their house in order to fix a defect in it, and there he asked her to walk beside him as he was an old man, and as soon as she approached him, he wrapped his hand around her shoulder and stuck to her and started kissing and feeling her, until she started screaming.

And an Emirati child, who returned from school after a school bus driver drove him to his home, and he was crying and spitting on the ground, as the maid who was waiting for him at the door asked him about the reason for that, and he told her that the driver kissed him from his mouth, and when his mother returned from work, he asked her to please She had an order in her ear, so he told her that the accused felt his body and kissed it, and the court ruled that he be imprisoned for three months with deportation.

An appeal judge in Dubai Court, Judge Saeed bin Sarm, stated that “in the majority of cases committed against children, the accused is not under the influence of alcoholic beverages or narcotic substances, and does not suffer from a mental illness that affects his criminal responsibility,” noting that “the main reason for The perpetrators’ commission of the crime is the neglect of families, and their failure to monitor their children.”

Among the cases he looked into, Bin Sarm said, "Unfortunately, families place their full trust in a worker they have, such as a driver, a farmer, or even a maid."

He gave an example with realistic stories that he passed on, including “an Indonesian maid who violated the honor of her employer’s child, due to the absence of parental supervision, and an Asian man teaching a child religious lessons in Dubai, who also violated his offer due to the absence of censorship, and his seclusion of the victim.”

rape

Concerning the punishment of the accused who is convicted of this crime, Bin Sarm said that it is “according to Article 356 of the Federal Penal Code, which states that “Whoever is convicted of an indecent assault, male or female, under the age of 14, shall be punished with temporary imprisonment.”

Bin Sarm explained that “indecent assault that is committed against a child is under duress, there is no indecent assault for anyone under the age of 14, because the child is not satisfied,” continuing either “the penalty for rape or sexual intercourse with a child, or sodomy with a child is death, according to the text of the article. (354), as coercion is considered existing if the victim was less than 14 years old at the time of the commission of the crime.

Bin Sarm stressed that “the Penal Code does not exempt a person who commits a crime while under the influence of alcohol, according to the text of Article (61) that if the loss of consciousness or will was caused by drugs or narcotic or intoxicating substances that the offender voluntarily and knowingly took, he shall be punished for the crime that occurred.” .

In addition, the head of the Family and Juvenile Prosecution in Dubai, Counselor Muhammad Rustom, stated that “family neglect of the child leads to serious consequences, up to the point of the child being exposed to a crime,” adding that “the school has a role in the education and control process, but the main oversight falls on the shoulders of family.”

Rustom stressed the need for parents to protect their child from servants, and that in each of them heedless of the child will be subjected to abuse, and not to leave him alone, whether in a shopping center or in a park or with the driver, and prevent him from going out to the street alone, provided that the supervision is not closely, where parents must Obligation to monitor them from a distance.

An incident, the perpetrator of which was punished with five years in prison with deportation, against a 23-year-old Indian man, indecently assaulted a child brought by his mother to remain in the care of the accused’s mother, who works as a babysitter. Then he took him on the bed and asked him to lick part of his body for him, and when the child refused he forced him to do so after he pricked him with the tip of a pen on his right thigh.

And another incident, committed against a girl who did not complete six years, her father left at a jewelry seller in a mall, to go to perform the prayer, and during her father’s absence, he felt her body, and when her father returned, he saw his daughter closing her clothes button and asked her about it, where she told him what happened, and she ruled He is charged with Dubai felonies with two years imprisonment and deportation.
