The administrative court of Melun (Seine-et-Marne) agreed on Wednesday to a caregiver at the Villeneuve-Saint-Georges hospital (Val-de-Marne).
The hospital had suspended the employee in September 2021 for non-vaccination against Covid-19.
The justice described this decision as a "serious and immediate attack" on its financial situation, reports

On sick leave before being suspended
The carer has since lived on 600 a month and two dependent children, one of whom is disabled.
His lawyer had denounced a “disguised disciplinary sanction”

For its part, the hospital believed that the complainant was at the origin of this situation by not respecting the vaccination obligation.
The court relied on a recent judgment of the Council of State to rule.
According to the defence, the applicant was on sick leave before the date on which she was suspended.
The court ordered the hospital to pay the complainant "the treatment to which she is entitled corresponding to the ordinary sick leave in which she is" and to pay her 1,000 euros.
