A federal court in
New York
today blocked former US President
Donald Trump
's attempt to sue and obtain financial compensation from writer
E. Jean Carroll,
who alleges the former president raped her in a store fitting room.
The writer, who was responsible for 26 years of
Elle magazine's "Ask E. Jean" column,
denounced in a book in 2019 that in 1995 Trump, then a millionaire real estate agent,
raped her in the dressing room of a popular store
for apartments in New York, but Trump accused her of being a liar and assured that she was only trying to sell a book she had just written.
Carrol's response was to sue him for defamation in November 2019, claiming that the then president had damaged his reputation and career by denying the accusation, to which
Trump responded with a similar complaint against her.
This is the one that has been denied today by Judge
Lewis Kaplan,
of the federal court for the southern district of New York, in
Manhattan.
Kaplan
believes that the intention of Trump,
elected president in November 2016,
is to further delay
Carrol's defamation lawsuit, which could have been resolved a long time ago, and recalled that the millionaire businessman waited 14 months to file his new complaint.
The magistrate also indicates that the defendant has not offered "a satisfactory reason" for that delay and that after Carroll filed the lawsuit,
he tried to avoid receiving notifications of it,
from his home in New York as well as from the
White House.
Finally the notice of the lawsuit had to be mailed.
The judge also criticizes the former president for having delayed the process of the lawsuit by presenting several
"frivolous" motions.
After that complaint, Trump
assured that Carroll, now 78 years old, was lying,
that he did not know her -despite a photo of them together in the book-, he said that she was not "his type" and that he only intended to call the attention to sell your new book.
He also suggested that Carroll was conspiring with the
Democratic Party
to harm him politically.
Among the arguments of her lawsuit, the writer affirms that readers no longer wanted to write to a woman whom the president has called a liar.
