In September, the requirement came from the Swedish Health and Care Inspectorate, IVO, that the University Hospital had until December to create 30 new care places.

If they did not complete, they would be forced to pay a fine of SEK 20 million.

The Uppsala Region appealed the decision to the Administrative Court, which upheld IVO's decision, but at the same time gave Akademiska more time to resolve the situation, until 2 February.

The requirement for unclear

This decision was in turn appealed to the Court of Appeal, which now revokes IVO's injunction because it is not considered to be formulated clearly enough and leaves too much room for interpretation as to whether the region has met the requirements or not.

- There are formulations in the injunction that are vague and unclear.

What does it mean, for example, that there should be as many care places as needed or that all patients' needs should be met?

It is not unambiguous.

Therefore, the injunction can not be approved, says the Court of Appeal lawyer Gertrud Forkman in a press release.

The Court of Appeal has not taken a position on how many care places are needed at the hospital.
