• Court The Prosecutor's Office asks to investigate those responsible for Health for discriminating with the vaccination of Police and Civil Guard in Catalonia

The Superior Court of Justice of Catalonia (TSJC) has sent to the investigating courts of Barcelona the complaint filed by various entities and unions of the Police and the Civil Guard against former officials of the Department of Health of the Generalitat, such as the former Minister Alba Vergés and the former director of the Servei Català de la Salut Adrià Comella for allegedly committing several crimes by delaying the covid vaccination of members of the Civil Guard and National Police stationed in Catalonia a year ago.

After considering that there is not enough evidence to accuse Alba Vergés, since she is a qualified person as a deputy of the Parliament, the court refers the procedure to the investigating courts to investigate whether the crimes of prevarication were committed,

A few weeks ago, the Prosecutor's Office urged the TSJC to accept the complaint against the ERC deputy Alba Vergés and the director of the Servei Català de la Salut Adrià Comella, considering that there were indications of his participation in these crimes.

Specifically, the Public Ministry recalled that the contentious administrative chamber of the TSJC already considered that the Generalitat discriminated against agents of the National Police and Civil Guards with respect to Mossos d'Esquadra and local police in the administration of the vaccine against covid.

However, in its resolution, the TSCJ agrees to file the complaint in relation to the appraised Alba Vergés and refer the rest of the procedure to the investigating courts so that, once distributed, they are the ones who agree on an investigation.

The magistrates indicate that in reference to Vergés "beyond her prevailing position in the hierarchical structure of the Department of Health of the Government of the Generalitat de Catalunya, there is no description of any action or omission that is directly attributable to her in the process of vaccination of the national police and civil guards carried out in the manner described above between the month of February and the month of April 2021".

The TSJC also points, with the documentation provided by the contentious chamber of the same court, to the former director of the Servei Català de Salut, Adrià Comella, since "he appears leading the relations of the Department with those responsible for the affected Security Forces and Bodies and adopting the decisions to suspend the vaccination process branded as discriminatory by the contentious-administrative jurisdiction".

For this reason, they consider that a Barcelona investigating court must be the one that "proceeds to carry out the appropriate investigations that allow discerning who could be objectively considered as guarantors and which authorities or officials could fail to comply with the duty to act imposed by the specific health regulations promulgated in relation to Covid-19" and that only the TSJC is competent if any appraised appears involved.

In this sense, the Prosecutor's Office considered in its brief that these "imputed criminal responsibilities can be extended" or other representatives of the Department of Health such as the current Minister Josep Maria Argimon.
