"It's the kind of trial you rarely see in a career as a lawyer", says Me Olivia Chalus-Pénochet about that of the attack of July 14, 2016, which left 86 dead and 450 injured in Nice, and which will begin on September 5 in Paris.

Six months before the opening of this "non-standard" and "historic" trial, the lawyer from Nice has encouraged the creation of "14-7 Avocats", a collective that brings together some forty lawyers from the Nice bar. , Grasse and Ajaccio.

It represents more than 300 civil parties with the objective of “being as close as possible to the victims” by offering “a local service”.

In this context, the group then “requested and obtained that there be a retransmission of the debates in Nice”.

Indeed, “the majority of the victims are from the Côte d'Azur, assures Me Adrien Verrier, president of the Order of Nice, also a member of the group.

Discussions are under discussion to agree on the terms, but the principle is in place.

It was difficult for the victims to be for three months more than 900 km from their homes”.

What organization for this historic trial?

As for the trial of the attacks of November 13, a psychological aid system will be put in place.

“The city of Nice has agreed to finance a support service by student lawyers, continues Me Verrier.

They will serve as an interface between the civil parties and the lawyers who will be in Paris.

This system will not make it possible to intervene directly during the hearings, it is not an annex of the Assize Court, but the students will be able to answer the questions of the victims and the latter will be able to have all the necessary information.

But unlike the Bataclan, the Nice attack took place “in an open environment” which makes the trial “quite unique”.

Thus, he underlines the relevance of this group which will present “a common argument”.

“We have few repositories in France with so many victims.

The other specificity of Nice is that it affected entire families, a lot of minor children, ”adds Me Chalus-Pénochet.

That evening, more than 30,000 people were on the Promenade des Anglais to watch the fireworks.

2,457 victims were compensated by the guarantee fund but only 865 victims filed civil suits.

"A moment of recognition of suffering"

"For this search for truth, to better understand and above all make their voices heard, express and share their suffering, it is essential that the victims become civil parties," says Me Sophie Hebert-Marchal, who is part of 14-7 lawyers.

They must be able to appropriate this trial.

Especially since the Court of Cassation has adopted since February 15, 2022 a broader conception of the notion of civil party for the specificities of terrorist attacks.

The collective emphasizes that the civil party victims who travel to Paris may be compensated.
