10 years imprisonment for a visitor in Dubai for “red liquid”

The Court of Appeal in Dubai upheld the criminal court's sentence of 10 years in prison and a fine of 50,000 dirhams, then deportation against an (Asian) visitor who possessed three vials containing 4,550 milligrams of a red liquid that turned out to be cocaine.

The Public Prosecution referred the accused to the Court of First Instance on charges of possessing a narcotic substance with the intent of promoting, but the court excluded the accused from the accusation and sentenced him to 10 years imprisonment and confiscation of the seized substance.

For its part, the Public Prosecution appealed the ruling before the Court of Appeal, demanding that he be punished as described in the referral order based on the availability of evidence regarding the accused’s possession of this amount of narcotic substance with the intention of promoting.

After examining the case by the Court of Appeal, it concluded that the appealed judgment fulfilled all the legal elements of the crime attributed to the accused, and provided evidence against him derived from what the police had testified, and what was proven by the report of the General Department of Criminal Evidence, in addition to the confession of the accused With my record of seizure and police inference.

With regard to the accused's denial, the court affirmed that it is not reassured by him and considers it a form of defense to evade punishment.

On the issue of the Public Prosecution’s appeal and its insistence on having the intent to promote, the court stated that it is evident to it that the appealed ruling surrounded the case with insight and insight, and pain in its circumstances and all the evidence in it, and ended with the lack of intent to promote the accused’s right, according to reasons the court deems justified, so it considers That the prosecution's appeal is misplaced.

The Court of Appeal confirmed that the judgment of the Court of First Instance ended in a valid conviction of the accused, which must be supported and punished with 10 years imprisonment and a fine of 50,000 dirhams, then deportation.
