has agreed to new proceedings to determine the responsibility of five members of the ETA Executive Committee in the order to assassinate the PP councilor

The decision comes after questioning two of them,

Iñaki de Rentería

After the appearance of the latter, the Prosecutor's Office did not request precautionary measures and stated that it did not see that there was a direct connection between the ETA leader and the specific attack in accordance with the demands of the Supreme Court.

On the contrary, the family of the murdered person, the AVT, Dignidad y Justicia and the PP continue to promote the investigation.

The judge indicates that the ETA leaders could be responsible for the attack either "as direct perpetrators, or as responsible for the crime committed by members of the terrorist organization ETA in commission by omission."

The magistrate now asks the Civil Guard "to locate and analyze the documentation held by members of ETA related to the Minutes of Meetings of the ZUBA or Executive Committee of ETA on dates immediately before, simultaneously with and after the murder of Gregorio Ordóñez".

Corroboration

Its intention is to "corroborate the attendance at the aforementioned meetings of the ETA leaders mentioned in report 20/2016 and the topics and issues discussed in them (with special interest in the references to actions against Popular Party politicians) in the framework of the destabilization strategy launched by ETA from 1994".

The murder occurred in San Sebastian on January 23, 1995.

In addition, it agrees to provide "the information that has been obtained from computer devices in 138 seals" (French judicial precincts) that were intervened after the arrest of

Mikel Antza

in 2004. The objective is to check if there were information or clues among the data related to the murder.

Finally, the judge also requires the addition to this case of another series of reports and sentences on the five leaders of the terrorist group and their participation in attacks and kidnappings investigated in other legal cases.

Hierarchy

The order issued this Thursday recalls that when Consuelo Ordoñez's complaint against the five former heads of ETA was admitted in 2015, it was established that ETA is based "on the basis of a hierarchy based on rigid discipline, which, under the protection of the leadership or executive committee, assumes all the managerial functions in such a way that there is nothing that that leadership does not control, promote or direct, as the body in charge of complying with the strategic lines of the criminal gang, whose members hold the quality of leaders and responsible for the main apparatuses of the group, including the military".

The decision-making, then indicated the order, to carry out a terrorist action applying the strategy designed by the executive committee was disseminated to all the militants through organic appointments or training courses and internal publications.

"The executive committee decides, coordinates, selects the targets, sends the information, delivers the necessary material to attack, generically designates the target and expressly orders to carry out the attack," he added.

Reorganization

After March 1992, after the dismantling of the ETA leadership in Bidart,

managed to reorganize the gang, incorporating new members into the "new ETA leadership".

The following year, these new leaders launched "the new strategy with which to recover from Bidart's police success and launched a campaign to destabilize the State with attacks against PP and PSOE militants."

"The attack against Mr. Gregorio Ordóñez Fenollar is part of that destabilization strategy of which those denounced through the executive committee or leadership of ETA are a part," says Judge Abascal.
