China News Service, February 21. On the 21st, the Supreme People's Procuratorate released the 34th batch of guiding cases and held a press conference on "Adhering to the People-Centered Strengthening of Criminal Protection of Personality Rights in the Internet Age".

Miao Shengming, member of the Procuratorial Committee of the Supreme People's Procuratorate and director of the First Procuratorate, said that this batch of 5 guiding cases mainly selected cases of criminal protection of spiritual personality rights. It's a "big thing".

At the press conference, a reporter asked a question. The Supreme People's Procuratorate's current batch of guiding cases focused on some "small cases" around the masses. What new features does this reflect in the criminal prosecution's case handling philosophy?

In this regard, Miao Shengming said that the five guiding cases issued by the Supreme People's Procuratorate reflect the following distinctive features:

The first is to handle the "small cases" around the masses with heart and affection.

This batch of Guiding Cases mainly selects and compiles cases of criminal protection of spiritual personality rights, which are basically cases of relatively minor crimes.

Although these cases seem to be "small cases", they are "big things" for the parties involved.

For example, the victim of Prosecution Case No. 137, Gu Mou, was slandered, which seriously affected his work and life, and suffered "social death"; the victim of Prosecution Case No. 138 was disseminated on the Internet because of his nude videos and pictures, which attracted much public opinion. Suicide by taking poison under pressure; Prosecution No. 139 victim's private life was sold as a commodity on the Internet; Prosecution No. 140 victim was frequently harassed due to leaked information.

For these "small cases", the procuratorial organs fulfilled their responsibilities, effectively punished the crimes, protected the legitimate rights and interests of the victims, and demonstrated the procuratorial responsibility.

Second, it reflects the judicial dynamic of procuratorial organs in the new era.

For example, Prosecution No. 136, the procuratorial organ prosecutes Qiu for criminal responsibility according to law, and at the same time initiates a criminal incidental civil public interest lawsuit, and simultaneously promotes the investigation of criminal responsibility and civil responsibility.

Prosecutorial Regulation No. 137, the procuratorate promoted the case from the private prosecution procedure to the public prosecution procedure, and innovatively applied the provisions of paragraph 2 of Article 246 of the Criminal Law, reflecting judicial wisdom and courage.

Prosecution No. 138, the victim's family reported that Yue was suspected of rape, and the procuratorate found that the existing evidence could not confirm that the suspect Yue was suspected of rape. Instead, it was carefully reviewed in accordance with the law, and it was believed that Yue was suspected of constituting a crime of insult, and the public prosecution procedure was applied in accordance with the law.

The third is to reflect the fact that the procuratorial organs have integrated socialist core values into judicial case handling, and lead social justice with judicial justice.

In recent years, remarks that insult and slander heroes and martyrs have appeared on the Internet from time to time. These remarks not only harm the reputation and honor of heroes and martyrs, but also hurt the emotions of the general public, harm social public interests, and impact socialist core values. Qiu gave full play to the educational and warning role of the case, reflecting the distinct value orientation of "heroes are the most shining coordinates of the nation" and "advocating heroes will produce heroes".

In other cases, procuratorial organs have also actively conveyed the values of maintaining personal dignity and protecting personal privacy through procuratorial case handling.
