A man of the nationality of a Gulf country fell victim to fraud by another Gulf national who claimed his ability to exchange a plot of land for another because of his experience in dealing with government agencies. A civil servant before the Partial Civil Court of Ras Al Khaimah to demand that the accused be obligated to pay him the sums of money he seized and 30,000 dirhams in compensation for the material and moral damages he sustained.

In detail, the plaintiff stated that he was subjected to fraud by the defendant, as he deluded him that he was able to complete the procedures for replacing the plot of land he owned and his family with another plot, with his experience in dealing with government agencies and familiarity with administrative procedures, and sent him the location of the new land that he claims will be handed over to him.

The case papers indicated that the plaintiff handed the defendant 97,600 dirhams, and it was found that the defendant’s allegations were not true and that he did not implement what was agreed upon. The plaintiff’s money, as the defendant was convicted of fraud and a court ruling was issued against him to fine him 10 thousand dirhams.

The case papers indicated that the defendant decided that what was stated in the lawsuit statement was incorrect and denied receiving money from the plaintiff, and pointed out that he had paid the fine imposed in the penal judgment, believing that he had paid a fine related to a communications complaint.

The operative part of the Civil Court stated that “the amount claimed by the plaintiff is not, in fact, a debt owed by the defendant, but rather a sum of money received to perform a service for the benefit of the plaintiff, and the plaintiff has the right to demand the return of the amount to take it from him without justification.”

She added, "It is established that the defendant took from the plaintiff unjustly and without a legitimate reason 97 thousand and 600 dirhams, and thus he is required to return the amount, and the court is heading to oblige him to return it."
