The trial of 19-year-old Vladimir Mushkambaryan, accused of rape and violent actions against a minor friend, continues in Moscow.

His lawyer and relatives point to numerous contradictions in the case, which, in their opinion, are not taken into account at the meetings.

As RT previously told, on July 8, 2020, a student at one of the Moscow colleges, Vladimir Mushkambaryan, met with his friend in a common company with Maria (name has been changed), who at that time was 13 years old. Vladimir was familiar with her, but, as his mother Irina says, referring to her son's friends, he never communicated closely. At the same time, according to Irina, the schoolgirl repeatedly tried to attract the student's attention, but to no avail.

The young people were asked to take Masha and her friend home.

When the guys drove up to the schoolgirl's house, she offered to watch some videos from the phone in the back seat of the car.

“She sat down on Vova’s knees and began to climb into his pants,” continues Irina Mushkambaryan.

- He drove her away, after which she called him into the entrance - ostensibly for a conversation.

There Masha continued to bother - to the extent that she partially undressed.

The son told her not to disgrace herself, to which she threatened: they say, he will see her again.

After that they returned to the guys who were waiting for them in the car ”.

Irina says that there are CCTV recordings, which show that Vova and Masha were absent for no more than ten minutes.

In addition, she continues, the girl left the entrance "almost skipping" and did not seem at all upset about anything.

The next day, the young people met again in a common company, adds Vladimir's mother: "We met as if nothing had happened, hugged, kissed on the cheek, and talked normally."

And on July 10, Maria wrote to the student, accused him of harassment and offered to meet.

Vladimir went to the meeting “to sort it out,” says Irina Mushkambaryan.

On the spot he was detained by operatives in civilian clothes - as it turned out, on the eve of Maria's mother, from her words, wrote a statement to the police about the rape of her daughter.

Alien DNA not found 

Mikhail Kopylov, a lawyer at the Narodny Advokat MKA, assures that he was not allowed into the police station where Vladimir was brought in for four hours: he could only meet with the student at the Investigative Committee.

“Vladimir said that the police officers put moral pressure on him, forced him to write a confession under the threat of arrest and allegedly filmed it all.

He added that he did not do what was written in the attendance, and we gave truthful testimony to the investigator, ”says the lawyer.

The young man was accused of attempted crime, rape of a victim under the age of 14, as well as violent acts of a sexual nature against a person under 14 years of age.

Since the articles are especially grave, Vladimir was placed under arrest.

At the same time, the examination did not find any physical damage, including microcracks, on the schoolgirl's body, or traces of someone else's DNA, although experts determined that the girl had not washed since the alleged rape.

Psychological and psychological examination did not reveal any deviations, including a tendency to pedophilia and violence, in Vladimir.

As for Mary, according to the results of the survey, there is also no clear connection between her state of increased anxiety and the allegedly committed rape.

Moreover, according to Irina Mushkambaryan, there is a video recorded immediately after the arrest of operational officers in the car, in which her son "as if by memorized phrases" says that his contact with the schoolgirl allegedly occurred by mutual consent.

This video, according to the lawyer, was not included in the case file.

"I bore my punishment"

Investigative actions lasted almost a year: according to the lawyer and Vladimir's family, the first months were not even interviewed with witnesses, and in the case several investigators managed to change.

Court hearings were also postponed due to the coronavirus pandemic: the first hearing in the Solntsevsky District Court took place only on November 16, 2021.

The court decided not to interrogate the victim of the alleged rape, confining itself to the testimony she gave during the investigation.

In the opinion of the defense, the hearing is biased.

“What is permissible for the prosecution is not permissible for the defending party,” notes Mikhail Kopylov.

- In particular, the injured girl was not summoned to the courtroom.

This request was denied and her testimony was read out orally. "

This is not the only thing that was denied to the lawyer: the court, in particular, did not review the video from the surveillance cameras, summon the colleagues of the operative who detained Vova (Irina says that he did not say anything definite at the meeting, citing that he no longer remembers the details), as well as a specialist who did an examination that did not find damage and traces of foreign DNA on Maria's body.

“The judge decided that calling an expert was pointless,” complains Vladimir’s mother.

- But how is it - senseless, if, for example, you can ask him if it is possible in principle to commit rape without leaving any microcracks or traces.

It seems to me that both the judge and the prosecutor understand that there is no evidence of Vova's guilt, and they want to close the case as soon as possible. "

Maria's mother was present at one of the meetings.

According to Irina Mushkambaryan, the woman in her application first demanded 500 thousand rubles in compensation in order to “spend it on the rehabilitation of her daughter,” but later this amount increased to 10 million rubles.

“What will they go to? I didn’t substantiate it, she said only, they say, I’m a mother of many children, don’t I need money?

At the same time, when the judge asked if she would be present at the next sessions, the girl's mother refused, and then added that Vova had already borne his punishment: “I no longer want to punish him, the rest is at the discretion of the court.”

But if I were in the place of a mother and my child, God forbid, suffered, then I would require at least a life sentence!

What kind of money can we talk about here at all? "

- Irina is indignant.

The victim's mother declined to comment.
