The prosecution on Monday recognized "dysfunctions" during the kidnapping alert triggered in December against the father of little Hamza, 12, whose trial for having "removed" the child from his maternal assistant was returned in March.

"Dysfunctions, I will not say that there was not, that would be to hide the face", launched Monday the assistant prosecutor Virginie Valton, in front of the criminal court of Béthune, where was to be judged Halim B., 40 years old.

At the request of several parties, who want more time to work on the case, his trial for “the removal of a child by ascendant from the hands of the person in charge of his custody” has been postponed to March 14.

He was kept under judicial supervision.

Several police reports

On December 17, around 8:00 p.m., he went to the maternal assistant, where his son was placed in the context of a conflictual separation, to take him away without violence.

The “worrying family context” had led the Béthune public prosecutor's office to trigger a kidnapping alert the next day, around 6.30 am, relinquishing the Lens police station in favor of the Lille judicial police.

But according to the investigation, several errors were made during the first investigations, starting with the phone initially used to locate Halim B., which was not the correct one.

In addition, the defendant telephoned the police station twice shortly after the incident, and also informed the educator.

He even showed up at the police station around 10 p.m. to drop a handrail, indicating that he had taken Hamza away because he "felt bad" in his host family and "was blackmailing suicide".

The next day, discovering the kidnapping alert, he contacted the PJ directly.

Precedents

There was "a material error", "malfunctions", but a few months before, Halim B. and his son had been "prevented by the Belgian authorities from boarding for the United Arab Emirates", where the family lived. and the father has settled down, Virginie Valton observed on Monday.

Also in September, at the end of a visitation right, he had "not returned the child to his mother", and although he called the police services, had refused to open the door to them.

Before starting "three months of wandering" with her son, she recalled.

"Incredible" affair

“This file is empty.

I only answered the distress call from my son, who told me he felt in danger, ”Halim B. said in court.

“I did what any dad would have done.

The investigation confirmed that the child did ask his father to pick him up and rushed into his car.

The case is "incredible", lambasted for the defense Me Damien Legrand, for whom the procedure "is not based on anything at all".

"We owe to the police officers the fact that they did not take into account the statement of the handrail that he made in one office, whereas in the other office of the same police station a colleague calls the public prosecutor of the Republic !

He deplored that "the prosecutor continues to maintain that all this is normal".

His client "was exposed in an undue manner to judicial vindication", he underlined, regretting that he "had his face presented on all the television channels".
