David Soares, a prosecutor in Albany, said in a statement that even if the woman is credible, the assessment is that they would not win a lawsuit.

Cuomo resigned in August last year on charges of sexual harassment.

Earlier in August, an independent investigation took place where eleven women testified about unwelcome approaches, stabbing or sexual allusions.

In October, police in Albany made a criminal report that Cuomo had pawed at one of the women.

Cuomo denies the allegations.

Recently, two other prosecutors in the state of New York decided not to pursue charges against Cuomo.
