It was in February that a man was found severely stabbed in his apartment in Oxhagen in Kalmar.

In Kalmar District Court, a 58-year-old man was sentenced to 15 years in prison for murder, a sentence that is now being changed by the Göta Court of Appeal.

The punishment is imprisonment for four years, at the same time as the sentence is changed from murder to aggravated assault and aggravated causing another's death.

Claims self-defense

The 57-year-old has admitted in both the district court and the court of appeal that he was in the apartment where the now deceased man lived and that a riot had arisen.

The convicted man has insisted that he did not use a knife or other sharp object against the man which caused the man to die.

He also states that he acted in self-defense, and defended himself with his hands and arms.

Unable to prove

The knife that was later found contained DNA traces from the convicted man, and the Göta Court of Appeal believes that it was the 57-year-old who caused the man damage to his chest and which caused him to die.

On the other hand, the Court of Appeal considers that it is not possible to prove that the 57-year-old intended to kill the man, and that he acted in self-defense and reduced the sentence to imprisonment for four years.
