The Ministry of Human Resources and Emiratisation has warned that families in the country resort to “unreliable” accounts on social media that promote tempting and deceptive offers to hire auxiliary workers, stressing that dealing with these accounts loses families the rights and privileges provided for in the Domestic Workers Law and its implementing regulations. It also exposes her to legal liability for whoever employs a worker in violation.

In detail, the Assistant Undersecretary of the Ministry of Human Resources and Emiratisation for Domestic Labor Affairs, Khalil Khoury, stated that some families in the country resort to social media accounts to search for a domestic worker, especially since the digital space is crowded with advertisements aimed at attracting those wishing to employ this category of workers by providing Attractive offers such as discounted prices, maid's home delivery service and other methods that can be described as deceptive.

Khoury said: “Dealing with these unreliable accounts has repercussions on the family, as it loses the rights and privileges stipulated in the Domestic Workers Law and its executive regulations, as well as the legal responsibility of those who employ a worker in violation, in addition to the possibility that the worker may be pregnant. diseases, which exposes family members to health risks,” stressing the importance of not dealing with any entity that provides auxiliary labor services through social media until after making sure that they belong to the centers that have been licensed by the Ministry of Human Resources and Emiratisation.

He added: “This can be confirmed by contacting the Ministry’s call center at 80060. These centers provide their customers with distinguished services through packages that suit the needs and requirements of families and employers. They also provide trained auxiliary workers familiar with the customs and traditions prevailing in our society and other advantages that It will guarantee the rights of those dealing with legal centers.”

According to the ministry, Federal Law No. 10 of 2017 regarding auxiliary service workers identified 19 professions within the scope of auxiliary service employment, including “employee, sailor, guard, shepherd, groomer, dresser, falconer, worker, housekeeper, cook, nanny, Farmer, gardener, private trainer, private teacher, private nurse, special representative, private agricultural engineer, private driver.

The ministry indicated, on its official website, that according to the Domestic Workers Law, no natural or legal person may act as an intermediary to recruit or employ workers temporarily unless he is a citizen and is licensed for that activity, and the licensed facility must have a citizen manager of good conduct. With the provision of the required guarantees as determined by the relevant executive regulations, confirming that the recruitment office may not request by itself or through a third party, or accept from any worker, whether before or after starting work, any commission in return for obtaining the work, or To collect any expenses from him.

The ministry stated that the Tadbeer centers, which operate under its supervision, are entrusted with carrying out the work of recruitment offices, and providing appropriate work visas, as well as providing advice, guidance, guidance and training for auxiliary service workers, noting that these centers offer four packages for the recruitment and employment of auxiliary service workers, the first is « Direct Sponsorship”, and through it, the Center for Recruiting Ancillary Services Workers from the source countries undertakes under the sponsorship of the family or the employer, provided that the worker remains under its guarantee for a period of 180 days, and the second is “Direct Sponsorship after six months.” This package offers the option of employment or temporary transfer. for the worker, which allows the family to employ the worker for a period of six months without being on its sponsorship, and after six months, the worker’s sponsorship is transferred to the family under a contract signed by both parties

According to the ministry, the third package is “guarantee by Tadbeer centers,” and this package provides the option to employ auxiliary service workers, provided that their contract with Tadbeer centers is for a period of two years and under their sponsorship, while the latter is “on-demand employment packages,” and this category of packages provides services Employing ancillary service workers on demand, which allows the family to employ the worker under the sponsorship of Tadbeer centers to provide services in flexible times according to the requirements of the family or the employer.

Regulating rights

The Ministry of Human Resources and Emiratisation confirmed that the Domestic Service Workers Law No. 10 of 2017, granted the Ministry the right and responsibility to set regulations and regulations for domestic service workers, in four main areas, including contracts for domestic service workers, rights and privileges of domestic workers and employers, caveats, and finally recruitment offices. employment.

She pointed out that the offices for the recruitment of auxiliary service workers must submit a copy of the job offer to the worker before the worker leaves his country of residence, and then sign the work contract approved by the Ministry of Human Resources and Emiratisation, which includes the terms and conditions of work, upon his arrival, noting that any of the employer or The domestic worker terminates the contract if the other party fails to fulfill his obligations.

The ministry stated that the employer or worker may terminate the contract even if the other party fulfills its obligations, and this is called termination with no fault of its own and is subject to compensation as indicated in the Law of Ancillary Services Workers.
