The plaintiffs denounce that "in this public group very serious threats are made towards" them and their son, "requesting that the center identify the family and the child, who is expressly asked to be expelled from the center or to be emptied in the class, in more extreme comments the knowledge of the family's address is demanded so that they can be stoned. For this reason, the parents of the minor emphasize that, "given the seriousness of the events, it is considered pertinent to reiterate once again to the management of the educational center and the Department of Education that it must preserve the privacy and security of the family and the child (out of five years) in school ". Thus, in the letter they urge the TSJC to remind the school management that, if it does not guarantee compliance with the judicial decision, it may incur a crime of obstruction of justice, punishable by four years in prison, the same that those who commit any act in "retaliation" against those who have promoted an action before the courts.
In a resolution of November 11, the General Secretary of the Department of Education ordered the center to comply with the judicial decision by teaching six and a half hours a week in Spanish to the class group in which the student is enrolled, mostly in the afternoon . The administration emphasizes that subjects such as play corners, graphomotor skills, visual and plastic education and psychomotor skills should be given in Spanish. However, the minor's parents consider that "the precautionary measure is not being followed", since subjects of the "curricular activity" such as language or mathematics are not followed, according to the timetable provided by the center, which will be done in Catalan.
For the family, these subjects "constitute the nucleus of the learning process and all these activities will be done in Catalan following an immersion model for Spanish-speaking children, since it is in the period of first teaching", so Spanish is left to "rather playful" activities.
For this reason, the plaintiffs ask that "some hours of the area of communication and language be taught in Spanish."
