November 22, 2021 The Milan court of review rejected the appeal of the defense of Shmuel Peleg, maternal grandfather of Eitan, the child who survived the Mottarone tragedy.



The appeal was presented by Peleg's lawyers against the international arrest warrant issued by the Pavia investigating judge against the 58-year-old accused of the kidnapping, on 11 September last, of the nephew entrusted to his paternal aunt and taken to Tel Aviv without his consent. .  



The arrest warrant was also issued against the driver who had helped them escape from Italy to Israel. A trip organized in detail by Peleg to escape border controls. 



As far as was known, the judges of the Review Court reserved the right to file the reasons, without however indicating a deadline. The grandfather, for the investigating judge of Pavia, together with his accomplice Gabriel Abutul Alon, an employee of the BlackWater company, specialized in paramilitary operations, would have put in place a plan to kidnap his nephew, who lived in Pavia with the family of his paternal aunt Aya Biran, his legal guardian. 



The grandfather and his accomplice, with the help of his maternal grandmother Esther Cohen (also investigated by the Pavia Public Prosecutor's Office) on 11 September brought the child to Lugano without the knowledge of aunt Aya.

From there, on a private flight, they reached Tel Aviv.

A blitz for which the investigating judge of Pavia, at the request of the Prosecutor's Office, asked for the precautionary measure in prison for the grandfather and the accomplice, thus opening the procedure for the measurement of the international arrest warrant.

Now the Milan Review Court has confirmed the request for arrest for the 58-year-old, a retired former colonel in the Israeli army.
