• The association Tous migrants, in the Hautes-Alpes, has taken legal action to force the State to set up reception solutions in this border department of Italy.

  • She argues that the prefect of Hautes-Alpes, Martine Clavel, "categorically refuses to take measures to protect exiled people".

  • A report on the shortcomings of this prefect was also sent to the prosecutor of the Republic of Gap by Sébastien Nadot, deputy for Haute-Garonne and chairman of the parliamentary commission of inquiry on migration.

Justice seized by an association for the reception of migrants in the Hautes-Alpes. The Tous migrants association, which supports exiles crossing the Franco-Italian border, has taken legal action to urge the State to implement a new reception of migrants in Briançon.

Filed Tuesday before the administrative court of Marseille, this application for interim relief aims to highlight "the failure of the prefect of Hautes-Alpes, to take measures allowing the reception and emergency accommodation of people exiled in Briançon" , according to the title of the document of which AFP obtained a copy.

"Despite deplorable living conditions, the prefect of Hautes-Alpes categorically refused to take measures to protect exiled people, opting instead for tougher border controls," adds the request, revealed by the daily

Closure of the only refuge

Like all the associations that have been helping migrants crossing the Col de l'Échelle pass for several years, Tous migrants notably requires the public authorities to put in place a system for sheltering exiles, after the closure in October of the only refuge intended for them in Briançon. It is also asking the State for the organization of public transport allowing them to leave Briançonnais, and easier access to PCR and / or antigen tests.

This new episode comes nearly a month after the closure, on October 26, of Terrasses Solidaires, a refuge which had been forced to stop its reception mission due to "arrivals greatly exceeding its capacities", in total. of 80 places.

Since then, the situation is tense in Briançon, where a demonstration again gathered 400 people on Saturday, but the public authorities, and in particular the Hautes-Alpes prefecture, are turning a deaf ear, deplore the associations.

"Deliberate endangering of the lives of these migrants"

Tuesday, the regional daily

Le Dauphiné Libéré

revealed that Sébastien Nadot, deputy for Haute-Garonne and chairman of the parliamentary commission of inquiry on migration, sent the public prosecutor of Gap a report pointing to "the failings" of the prefect of Hautes-Alpes in view of the situation in Briançon.

For the deputy, “the acts” of Martine Clavel constitute a “deliberate endangerment of the lives of these migrants”, he underlined in the columns of the regional daily.

Reached by AFP, Florent Crouhy, the prosecutor of the Republic of Gap, declined to comment, while specifying that the report in question, transmitted "under article 40 of the Code of Criminal Procedure", was "under analysis".

The administrative court of Marseille will examine for its part the request of the association Tous migrants on November 24.
