The case papers stated that the plaintiff had suffered material damage, represented in the attorney fees, and severe physical injuries to the face, which needed rehabilitation, which resulted in permanent disability, according to what was stated in the medical report, and needed future treatment and plastic surgery to mitigate the impact of the injury, in addition to She paid 7,655 dirhams as a civil claim fee, and for the moral damage she sustained as a result of the injuries she sustained in her face and she is still in the prime of her youth, which affected her outward appearance and psyche, and she became sad and terrified, especially since the injuries almost cost her life.

In the lawsuit, the plaintiff demanded to compel the defendant to pay her 900,000 dirhams in compensation for physical and moral damages, 100,000 dirhams in compensation for damaging her car, and obligate him to pay her fees, expenses and attorney's fees.

The plaintiff’s attorney, Hanan Al-Bayed, submitted a memorandum in which she held to the requests for moral and material compensation, while the defendant’s attorney, Lawyer Ramzi Al-Agouz, submitted a memorandum requesting the rejection of the case for lack of legal basis, considering that the damages claimed by the plaintiff are not fixed and need investigation. He explained that the ruling issued by the Criminal Court against his client did not prove that he was the one who inflicted the damage on the plaintiff, and that the plaintiff did not suffer a permanent disability, and there were previous disputes between the two parties, and he requested the rejection of the case and the assignment of a car expert to inspect the plaintiff's car to show the damages, even if it is usable After its maintenance, and as a precaution, a tripartite committee of doctors from the Ministry of Health and Community Protection was delegated to perform a medical examination on the plaintiff to show her injuries, even if the injury to her face is likely to disappear or result in permanent disability.

The reasons for the partial civil court ruling stated that the criminal court convicted the defendant for the crimes attributed to him, to imprisonment for a period of one year and a fine of 3000 dirhams, as a result of assaulting the integrity of the victim’s body, by deliberately crashing into her car, and hitting her with a knife, causing injuries that left her. Permanent disability, severe disfigurement in her face, insulting her, endangering her life and damaging her car.

The court estimates the compensation for the material damage at a value of 70,100 dirhams. As for the compensation for the value of the car, the court considers that the case will not be accepted by someone who has no capacity, as the car belongs to the plaintiff’s father and not to the plaintiff.

She pointed out that the defendant's assault on the plaintiff with a knife left her with injuries, facial disfigurement and permanent disability, insulting and stalking her, and the fear and terror she felt on the day of the incident and the defendant's collision with her car, makes the moral damage permanent, because it is a serious and continuous damage and inherent to the plaintiff, and the court appreciates compensation for A moral damage in the amount of 70,000 dirhams as a result of the crimes committed by the defendant towards the plaintiff.

She stated that the court obliges the defendant to pay the plaintiff 140 thousand and 100 dirhams in compensation for the material and moral damage incurred by her, and obliges him to pay fees, expenses and attorney's fees.
