A partial civil court in Ras Al Khaimah ruled that the parents of two Gulf children (15 and 16 years old) must jointly pay 7,000 dirhams to a Gulf citizen in compensation for moral damage caused by them driving his vehicle without a driver’s license, without his permission, and destroying it.

In detail, the plaintiff filed a lawsuit, in which he stated that he had suffered material and moral damages, as a result of the two children, sons of the defendants, using his car without his permission, and causing damage to it, which led to it being stopped and transported to the “garage” for maintenance and repair, and he was harmed by trespassing on him in his property.

The case papers indicated that the criminal court had ordered the two children to be reprimanded and handed over to their guardians, and the plaintiff had sustained material damage, which was represented in the expenses of maintaining and repairing his vehicle, and the judicial expenses incurred, and fees for attorneys’ fees, and the lack of market value of his car, and his inability to work after seizure His passport, as well as moral damage, due to the damage to his car, and his appearance as a defendant based on a false allegation from the son of the second defendant.

The plaintiff demanded to oblige the defendants to pay him, jointly between them, the appropriate compensation estimated by the court for the material and moral damages he sustained as a result of the criminal act committed against him, while obligating them to pay fees, expenses and attorney fees. Original ruling rejecting it, and obligating the plaintiff to pay fees and expenses.

In the ruling, the Partial Civil Court of Ras Al Khaimah confirmed that the authority of the penal ruling against the two children is bound by the court, as it is a chapter on a common issue between the two lawsuits, and it has become final, and thus the fault of the two children is the sons of the defendants, for whom we were criminally convicted, and for the crimes for which they were charged. They committed it against the plaintiff, and it was a direct cause of the moral damage he suffered, which was his feeling of sadness and sorrow as a result of their use of his car without his permission, and the damage they caused to it.

She explained that there was a causal relationship between the harmful act and the moral damage he had sustained, and his request for compensation is valid. A moral damage in the amount of 7000 dirhams, and they are obligated to pay it to the plaintiff jointly between them, in addition to obligating them to pay expenses and attorney fees.
