The Advocate General, Head of the Nationality and Residency Prosecution, Counselor Ali Hamid bin Khatam, revealed that many national families have begun to employ support workers, particularly servants, on a part-time or temporary basis, instead of bearing the cost of the maid’s residence, and at the same time they have Margin of time and freedom to return the maid if they do not like her performance, or both parties are not comfortable together.

He stressed that the temporary work system has reduced many violations of work by non-sponsors, and closed the door to the problem of escape of auxiliary workers, because they can now practice their jobs legally while they are under the sponsorship of their offices.

In detail, Counselor Ali bin Khatam said, during a virtual seminar organized by the Neighborhoods Council in cooperation with the Community Development Authority, under the title of the rights and duties of sponsors and those who are sponsored by support groups, that the recruitment offices of auxiliary workers operating in Dubai have become more selective for the labor they bring, and subject them to appropriate training. And this is the origin and role entrusted to the office before the supporting groups begin to carry out their duties in accordance with the requirements set by the Ministry of Emiratisation and Human Resources.

He added that there are specific steps that the homeowner or the employer must abide by in the event the worker flees: the first of which is to go to the office and claim legal rights, including refunding the value of the remaining period of the contract, if the worker ran away before two years of his employment, and if the office did not comply or respond, he goes The employer to the Ministry of Emiratisation and Human Resources, and if a solution is not reached, he goes to the court and must have a copy of the contract signed with the office and that signed by the worker, the receipt in which he paid the contract amount to the office, and receipts proving his commitment to paying the worker’s monthly salary before That last escape.

He revealed that many families neglect the worker's signature on the salary receipt, which wastes their rights in the event of his escape or breach of contract, pointing out that there is a receipt book that must be obtained from the labor recruitment office, to avoid any future allegations from the worker about not receiving his salary.

He explained that there are measures that have contributed to a large degree in reducing the problems related to supportive labor, especially the flight of servants, or citizens registering workers on their sponsorship and allowing them to work for their expatriate friends, given the difference in the cost of fees, noting that the most important of these measures is the application of the working hours system. Partial or temporary work, which allows offices to keep workers on their sponsorship and employ them by the hour or by the day.

He pointed out that the national families themselves have become preferring this type with time, because although its cost is more, it is offset by the easing of several obligations, including the procedures for issuing residency for the worker, as well as the possibility of returning him, whether he is a maid or any of this category if he is not with the appropriate efficiency and replacing him. otherwise.

Adviser Ali bin Khatam:

• "The auxiliary labor recruitment offices that operate in Dubai now have become more selective about the labor they bring."

trap misinformation

The Public Defender and Head of the Nationality and Residency Prosecution, Counselor Ali Hamid bin Khatam, warned against falling into the trap of misleading information by some companies recruiting and employing support workers, especially with regard to the guarantee period or insurance.

He said that some companies convince the sponsor that the guarantee period is six months, but this contradicts the truth, as the due guarantee period is two years, and in the event that the supporting worker escapes, the employer has the right to recover the remainder of the contract value, provided that he is not responsible or violating any of the terms of the contract such as Non-commitment to pay the salary, or assault in any way on his worker.
