The National Court ordered the full reopening of the
Dina case
, the part of the
Tandem macro case
that investigates the theft and recovery of the mobile card of former Pablo Iglesias advisor Dina Bousselham.
The court that reviews the decisions of the investigating judge has revoked the records with which Manuel García-Castellón concluded the investigation phase.
He orders him to take a statement from Bousselham, his partner and the former Deputy Director of Operations (DAO) of the Police Eugenio Pino, as requested by the
Anti-Corruption Prosecutor's Office
.
In fact, a part of the
Dina case was
still open in court after the Supreme Court considered the investigating judge's proposal to impute Iglesias, who was at that time, rash.
The court is awaiting a final report from the Scientific Police that could shed light on the future of the card, which Iglesias kept for months after recovering before returning it to Bousselham.
The Third Section of the Criminal Chamber now reopens the entire case, in response to the five appeals presented by Anti-Corruption, Pablo Iglesias, Bousselham, the retired commissioner José Manuel Villarejo and two
Interviú
journalists
against the order of the investigator who proposed to try the three last and sent the rationale to the Supreme.
In the order in which it fully considers the appeal of the Prosecutor's Office, which considered that the case had been closed prematurely.
The Chamber understands that the proceedings requested by the Public Ministry are "proceeding for the purposes of the investigation."
Bouselham has already declared several times about the screenshots of his phone published in

after the theft of his mobile, but the magistrates consider that in order to exhaust the investigation "it is necessary to know, as far as possible, the origin of the disclosure by the media since January 2016 of other information contained in the telephone ".

In relation to the statement of his partner, Ricardo Sa Ferreira, the Hearing understands that it could serve to explain some "gaps" in the information he provided on the theft of the telephone and recovery of the card.
To date, Bousselham has given several versions of the status of the card at the time Iglesias sent it to him.
The court also considers it necessary to question the former Deputy Director of Police Operations (DAO) Eugenio Pino as a witness, "to clarify the consistency of the statements" of the two journalists that the information they provided to Villarejo was in the belief that it was in the framework of a police investigation.
The appeals of Iglesias and Bousselham also asked to question Pino, although other claimed testimony has been rejected.
The magistrates of the Court also ruled out ruling on the rationale sent by the Central Court of Instruction Six to the Supreme Court referring to the possible imputation of Iglesias -when it was measured- considering that it is not within its competence.
In another of the proceedings, the Chamber rejects the joint appeal of the journalists of the extinct magazine Interviú against the order of the investigator who considered that they should be tried for the crime of revealing secrets. The Court understands that, contrary to what was argued by both, the judge's order describes the events that occurred with Bousselham's memory card and the delivery of its contents to a third party, an action classified as a crime of discovery and disclosure of secrets.
Finally, the Hearing dismisses Villarejo's appeal in which he requested the reopening of the procedure to incorporate the chats contributed by former Podemos lawyer
José Manuel Calvente
included in a case processed in the Madrid court.
"The incorporation to the procedure of the chats will serve in his case to assess the credibility or plausibility of what was declared by the witness that is typical of the oral trial phase and may be interested as evidence to be practiced in it", conclude the judges.
