This legislative change is based on the elimination of two key issues introduced in 2003 in the Penal Code by the Government of Aznar. But, above all, the 2003 reform toughens the conditions for ETA members to get out of jail upon achieving the third degree or parole.

Since then, imprisoned terrorists have to serve a minimum of four-fifths of the maximum sentence limit in order to qualify for the third degree, and this requirement is even higher for parole.

In addition, it is established that to obtain the change in grade there must be an individualized and favorable prognosis for social reintegration, but this obstacle will be easier to overcome after the transfer of prison management to the Basque Country.

The government of Iñigo Urkullu has announced that it will multiply compliance with "semi-freedom" of sentences and it remains to be seen how it influences the treatment boards that have not yet met after the transfer.

At the moment, 104 prisoners have already formally requested their transfer to the Basque Country.
