"I want justice for him, if a person makes a mistake he has to pay for that mistake. You cannot teach the youth that you can drive drunk, without insurance, skip help, turn yourself in later and get away with it. Everything is so incredible." This is how Mónica expresses herself, the mother of a 19-year-old young man who died on October 11 after a drunk driver ran over him when he returned from work to his home in the center of Empuriabrava in Castelló d'Empúries (Girona). It is a case that adds to the pain of the family over the death of the boy the police and judicial nonsense that have led the parents' lawyers to demand in the courts of Figueres the arrest of the suspect as well as that measures be adopted against him as a withdrawal of the driving license or even imprisonment.

One of the family's lawyers, Daniel Vosseler, explained that several witnesses explain how the young man came back from working as a stockman in a supermarket and was driving his electric scooter cautiously down a street in the municipality when a car at full speed hit him and He threw it at 15 meters, "a huge distance in terms of road safety," says the lawyer. The driver did not brake and collided with another parked car, the owner of which spoiled his action, and stopped as the airbags went off. Later he escaped on foot from the scene of the accident, leaving the young man badly wounded. He died hours later in the hospital.

A while later, the driver appeared before the Local Police of Castelló d'Empuries and tested positive for breathalyzer in the two tests they did, so the lawyers conclude that his blood alcohol level had been reduced since the accident. . After spending several hours at the police station, the officers let him go. For this reason, Daniel Vosseler considers that it is a "manifest irregularity" by the police since he should have been detained and appeared in court, which did not have the opportunity to decide whether to adopt precautionary measures against him. "After four hours they released him without waiting to know the status of the victim," he said.

"Today it continues to circulate with total freedom, justice has not been made available," says the lawyer who assures that the suspect "has not had the decency to call the family and ask for forgiveness."

The family lawyers will ask the court to arrest the driver and to enter prison as a precautionary measure for the reckless homicide and to leave the scene of the accident.

Nor does he rule out requesting that the actions of the local police with the suspect be investigated since there is no record that they notified the Mossos d'Esquadra, who are competent in this type of crime, so they believe that the protocols on custody of detainees.

Judicial confusion

The lack of a police report caused a court in Figueres to open proceedings for his death, after being communicated by the hospital, and without having any more information, having to file the case to avoid the prescription. It was not until another court in Figueres received two handwritten complaints from the parents that they saw that there was a relationship with the accident. After receiving the police reports, the court reopened the procedure, charged the driver and summoned the people who saw the accident to testify as witnesses.

"He evaded the place of the accident to avoid his responsibility and due to an anomaly he is still free, without having gone through the court," explains the other lawyer of the Álvaro Machado family about the suspect.

He also regrets that he spent 4 hours at the local police station without going to court.
