Report Congress lawyers assure that Alberto Rodríguez can continue as a deputy
Sentence The former secretary of the Podemos Organization Alberto Rodríguez must leave his seat after being condemned by the Supreme Court
Perplexity and indignation in the
Supreme Court
after the decision of the Board of Congress to keep the deputy of Podemos
Alberto Rodríguez
with his seat despite the sentence imposed by the Second Chamber for having kicked an agent of the authority during a demonstration on January 25, 2014, in the town of La Laguna, against the so-called
Wert
Law
.
On October 7, the High Court condemned the former secretary of the Podemos organization for a crime of attacking agents of the authority to a month and a half in prison, which he replaced with a fine of 540 euros.
The sentence included the accessory penalty of special disqualification for the right to passive suffrage and, consequently, the loss of the seat due to unforeseen illegibility.
In the ruling of the sentence, a presentation by magistrate
Manuel Marchena, it
was agreed to notify the
Central Electoral Board
"for the appropriate purposes."
In other words, the direct consequence of the firm conviction was that Rodríguez had to abandon his seat in Congress, legal sources emphasize.
From United We can then questioned whether this should be the case, highlighting that the prison that would entail this disqualification to continue in the seat had been replaced by a fine and they asked the Supreme Court to rectify it by clarifying the sentence.
The Chamber responded to the defense of the Podemos deputy that there was no room for rectification since the fact of replacing the prison sentence with a fine does not exempt the convicted person from compliance with the accessory penalty.
Even so, the PSOE and United We Can have teamed up this Tuesday at the Table of Congress to allow Rodríguez to keep his act as a deputy based on the report drawn up by the Chamber's lawyers, unveiled yesterday by EL MUNDO.
From the High Court this decision is described as "very serious" since it is "reinterpreting the will of the court" and that in a "final judgment it held that this man was disqualified" for the right to passive suffrage.
Legal sources consulted emphasize the precedent established by Congress with this decision is "very dangerous" and regret that the decision of the Bureau of Congress is a kind of appeal against the sentence of the Chamber.
