Changed under description from promotion to abuse

“Appeal” commutes the sentence of two Gulf nationals accused of drug trafficking

The Court of Appeal in Sharjah decided to reduce the sentence of two Gulf nationals accused of possessing psychotropic substances with the intent of using and promoting, from two years imprisonment, to a fine of 10,000 dirhams, and to release them, given the change in the description from promotion to abuse, and the second accused’s record is free of any criminal offense, and that The first accused returned to drug use after 10 years of recovery from addiction.

In the details, the Public Prosecution charged the first and second defendants with possession of 300 grams of crystal and two rolls of hashish, with the intent of promoting.

The defense of the defendants, Lawyer Saud Muhammad, confirmed before the Court of Appeal that there was no connection between his clients, the absence of flagrante delicto against them, and their complete denial from the beginning of the investigations until the preliminary court sessions. A balance was seized that the two accused were using as evidence of the charge of possession with the intention of promoting, but the fact that the two accused were doing was the weight of the goods they purchased, in order to ensure that the amount they paid for is correct, and they were not deceived by the seller.

He explained that the laboratory report, after examining the two samples of the accused, proved that they had used the same psychotropic substances that they had in their possession, which confirms that possession is for the purpose of abuse and personal use, and not for promotion and trafficking.

The lawyer petitioned the court to acquit the defendants of the charge of distributing psychotropic substances without the authorized conditions, and of using clemency with them in the accusation of “abuse”, especially since the second accused has no criminal record, while the first committed himself to refraining from using narcotics and psychotropic substances since In 2011, i.e. 10 years ago, he made a full recovery, and his discipline in conducting periodic examinations, all of which were devoid of substance abuse.

The Court of Appeal decided to reduce the sentence of the defendants from imprisonment for two years to a fine of 10,000 dirhams, and to release them. The authority also changed the description from possession with the intent of promoting and using, to the charge of using psychotropic substances without legally authorized conditions.
