The Prime Minister of Holland, Mark Rutte, will ask the European Union to withhold the 36 billion euros of Recovery allocated to Poland following a controversial ruling by the Polish court that has weakened its membership in the European bloc.

The European Commission has already delayed an assessment of the Polish application for funds and is still deciding if and when to release them.

Bloomberg reports it.

The case

The Polish Constitutional Court, led by Judge Julia Przylebska, declared last Friday that some European Union regulations are not compatible with the Polish state constitution.

According to the Court, this judgment refers to the competences of the Polish State which have not been transferred to the bodies of the European Union. The decision of the Court, much awaited by Brussels, could negatively affect the future of the Recovery Fund for Warsaw, which has been bound to respect the Polish rule of law, which has long been weakened by European standards. The dispute concerns above all the lack of autonomy of the justice system, which has been placed under the control of the ruling party Law and Justice of the leader Jaroslaw Kaczynski.
