The ERE's 'zero' intruder, on trial a decade later

Antonio Garrido Santoyo

of the ERE. He was a leader of the local executive of the PSOE of the Jaén municipality of

and a member of the UGT union. He never worked in

, the wholesale supply market in Seville, but his name was included in the list of employees of the fish market who took early retirement through an employment regulation file (ERE) in 2007 that was paid for by the Junta de Andalucía, then chaired by the socialist Manuel Chaves.

When judge Mercedes Alaya began to pull the thread of the irregularities in Mercasevilla, she came across the ERE case, the largest cause of corruption ever investigated in Spain, which uncovered the plot orchestrated by the successive Andalusian governments of the PSOE to support their own power through an arbitrary distribution of millionaire funds in exchange for loyalties and favors. In a decade,

were spent

on fraudulent EREs, as stated in the judgment of the Seville Court that sentenced a score of former high-ranking officials, including former presidents Chaves and José Antonio Griñán.

Part of that millionaire sum paid by the Board went to the

: people completely unrelated to the companies in which the ERE were made paid for with public money, but who were included in the lists of workers who took early retirement with generous

The first intruder discovered in the ERE case was Garrido Santoyo.

During a period - from November 1, 2007 to April 30, 2009 - he was charging

.

In total, his early retirement plan reached 112,000 euros.

He had payments committed

.

However, after the scandal broke out and months after starting the judicial investigation, Garrido Santoyo

and entered the court's account 92,852.53 euros in concept of "the amounts wrongly received" during the months that he was collecting as false early retirement or intruder in the ERE of 2007 of Mercasevilla.

The condition of intruder in the Mercasevilla de Garrido Santoyo ERE was discovered in November 2010. Two months later, on January 19, 2011, Alaya opened the preliminary proceedings 174/2011, which gave rise to the macrocause of the ERE.

The Board does not accuse

Now, when a little more than ten years have passed since the beginning of the investigation, the new investigating judge,

, has just opened a trial against Garrido Santoyo and another ten people for the ERE of Mercasevilla. The prosecutor has requested two years in prison for the

as a necessary cooperator of a crime of embezzlement. The Board, on the other hand, has not brought an accusation against him.

Along with the

, the former directors of Mercasevilla

and

, already convicted of bribery in said entity,

will sit on the bench

; the former members of the Vitalia consultancy

; former UGT trade unionist

; his brother-in-law

as Lanzas tax advisor;

as his front man and

, administrator of Hermes Consulting.

The instructor, likewise, requires the eleven defendants to, within a day, provide different

-which in some cases reach

euros- to ensure the pecuniary liabilities that could be imposed, with the warning of that, if they are not lent, goods will be seized in sufficient quantity to ensure the amount claimed. The judge imposes on Mercasevilla a bond of 4.3 million euros.

In one of his files, the judge warns that the Junta de Andalucía granted Mercasevilla aid

.

Specifically, for the first ERE, that of 2003, the Andalusian Government approved and paid an aid of 5.6 million euros, while for that of 2007, it gave the green light to an aid of almost 7 million euros that, without However, at the last minute, he did not pay in full.

Rio Grande

The ERE instructor has notified this Wednesday a second order in which he opens an oral trial against

accused of the aid to

SL once the accusation writings have been received from the Public Ministry, the Junta de Andalucía and the PP-A .

Among the nine indicted in this separate piece of the ERE case, are the sole administrator of the company; several managers and workers of the mediator Vitalia, of the entity Atrado Mensajería SL and of a law firm, and an 'intruder' - a person who was included as a beneficiary of an insurance policy despite never having been a worker in Río Grande- .

Thus, the judge opens a trial against the nine investigated in this separate piece of the case for alleged crimes of administrative prevarication and embezzlement;

against six of them for a continuing crime of document falsification, and against one of the accused for an alleged crime of influence peddling.

In this sense, it also opens oral proceedings against Río Grande Sevilla, the aforementioned law firm and Atrado Mensajeria as subsidiary civil liable parties.

The judge, in this case, also requires the nine defendants to, within one day, provide different bonds - ranging between 1.9 million euros and 165,000 euros - to ensure the pecuniary liabilities that could be imposed, with the warning that, if they are not lent, goods will be seized in sufficient quantity to ensure the amount claimed.
