October 10, 2021 It was already known that the third hearing on the case of Eitan, the little survivor of the Mottarone tragedy, would go on indefinitely. And so it was: it started at 13.30 and is still in progress. A closed-door hearing at the Tel Aviv Family Court. At the end of which Judge Iris Ilotovich Segal will make her decision known within two weeks, as reported by the lawyers. The trial focuses almost entirely on the basis of the Hague Convention and on international child abduction. The Convention, signed by both Italy and Israel, is in fact at the basis of the request, for the immediate return to Italy of the child, by the paternal aunt, Aya Biran, entrusted with his protection,against the paternal grandfather of the child Shmuel Peleg who brought the child to Israel and who is being investigated in Pavia for the kidnapping of Eitan. 



In the classroom, as in the other hearings, both the paternal aunt and the maternal grandfather, but Gali Peleg, daughter of Shmuel and sister of the child's dead mother, was also heard, who in the past weeks announced that she had asked for the adoption of the baby. . Also heard from a lawyer expert in Italian law.


The lawyers of the paternal aunt, Aya Biran, argue that for Eitan the Hague Convention must be fully applied and therefore the child must return to Italy. On the other hand, the lawyers of the Pelegs contest the position, also casting doubts on the legitimacy of the custody (on which a lawsuit brought in Italy is planned in the coming weeks). 



Pending the decision of judge Ilotovich Segal, Eitan will continue - on the basis of the "temporary agreement" of the two families, favored by the judge - to be entrusted alternately three days with his aunt Aya Biran Nirko and three days with his grandfather Peleg.

Meanwhile, the lawyers have already leaked the possibility that one or the other party opposes the verdict.
