some articles of the European treaties are "incompatible" with the national Constitution

and affect the sovereignty of the country.

protect the primacy of European law,

in the words of Justice Commissioner Didier Reynders.

The TC decision delves into the disagreement between the Polish and European Judicial Power, which have faced each other since the Polish Government undertook a profound judicial reform in 2015.
