The judicial investigation continues to advance on the macrocause of corruption of the ERE, which affects the previous Andalusian governments of the PSOE.

The investigating judge sees indications of alleged crimes of

embezzlement and prevarication

in the employment regulation file (ERE) that was made in the public company of the

Egmasa

Board

from the year 2003, during the stage of Manuel Chaves as president of the Andalusian Government .

The Board, through the General Directorate of Labor and Social Security, headed by

Javier Guerrero

, who died a year ago, granted exceptional aid of

21,673,680.62 euros

in an "unfair and arbitrary" way - according to the judge - to pay the layoffs of about 350 employees.

Those affected by the ERE were guaranteed

95% of the monthly net salary

increased by 2% annually until they reached 65 years of age or could opt for a compensation of 20 days per year worked.

From the age of 65, they would go on to collect the corresponding pension from Social Security.

Egmasa submitted in June 2003 an ERE request for the termination of

373 contracts

for "productive and organizational reasons" related to the need to renew the workforce of older people, given their physical incapacity to carry out their work within the plan. Infoca, the device for

After negotiation, it was agreed that the ERE would affect

348 workers

.

The judge highlights in his order how "all" the employees included in the ERE had previously worked in town halls and councils within the framework of

the Rural Employment Plan (PER)

, and after leaving their posts, they went on to receive "unemployment benefits or subsidies for people

over 52 years of age

, being then relocated to Egmasa ». In fact, when the ERE was processed, those affected "had been working an average of no more than 4 years" at Egmasa.

Therefore, the Board was dedicated to

recruiting people over 52 years of age

to take early retirement later with public money and under very advantageous conditions. None of those affected by the ERE was a veteran who had been assigned to the Infoca firefighting device for decades, since the average seniority in Egmasa was four years.

For these facts, the reinforcement judge of the Court of Instruction number 6 of Seville,

, has prosecuted nine people: the former director general of Labor and Social Security of the Board

Daniel Alberto Rivera

;

five Egmasa executives;

a trade unionist from CCOO, and two managers from the mediator Vitalia.

Likewise, the instructor agrees to continue the preliminary proceedings as an abbreviated procedure, as subsidiary civil responsible, against Egmasa, Vitalia, the Workers 'Industry Commissions, the Trade Union Confederation of Workers' Commissions and the Trade Union Confederation of CCOO in Andalusia.

Juan Espadas

Egmasa's ERE and all the irregularities associated with it dot the new general secretary of the Andalusian PSOE, Juan Espadas.

The judge sees evidence of crime in the 21 million aid granted to Egmasa, of which there are payments made from 2004 to 2010 by the IDEA Agency totaling 16,069,3918.88 euros.

Espadas was the Chairman of the Board of Directors of Egmasa in his capacity as

Deputy Minister of the Environment

(2004-2008).

In fact, the PP, personified as a private prosecution in the ERE case, asked the investigating judge

María Núñez Bolaños

to declare in court all the members of the board of directors of the public company between 2003 and 2007. The magistrate did not agree to this request.

It is not the only link between the new leader of the Andalusian PSOE and the irregularities in the ERE of Egmasa.

As EL MUNDO reported, Egmasa's board of directors became aware, in Juan Espadas' stage as president,

of the Intervention's warnings

in relation to the ERE encouraged by the Board, but did not adopt any measure.

Among other issues, the auditors reproached that the

express authorization of the Governing Council

had not been required

, before the collective income insurance was formalized through which the Egmasa workers' early retirement plan was implemented, by overcoming the file of I spend the maximum limit of 12.1 million established by the Budget Law of the Autonomous Community of Andalusia for 2003.
