• Hearing The judge sends former Minister Fernández Díaz and his Interior leadership to trial for spying on Bárcenas in the Kitchen operation

  • Appeal Fernández Díaz maintains that Kitchen has been closed "in false" and affirms that the responsibilities should be sought in the PP, not in the Interior

The former treasurer of the PP, Luis Bárcenas, asks Judge Manuel García Castellón to reopen the investigation of the 'Operation Kitchen' to purge the "necessary responsibility of Mariano Rajoy" and clarify his "knowledge and participation" in the espionage operation against him .

The former head of the party's finances has just presented an appeal against the closure of the investigation, agreed by the judge a couple of months ago, to which EL MUNDO has had access. It should be remembered that the instructor ended the investigations, leaving the case one step away from the oral trial and placing the highest officials of the Ministry of the Interior during the government of the PP as the head of the operation to spy and steal sensitive documentation from Bárcenas. At the head of them, the former Minister Jorge Fernández Díaz and the former Secretary of State for the Interior accompanied by the police leadership of the time.

Bárcenas highlights in his writing that "it does not seem coherent or reasonable to ignore the obvious fact that it was a Ministry of the Interior under the presidency of Rajoy." "Being the political positions of said ministry members of the PP, which was affected en bloc by the information that they illegally stolen using the officials of the State Security Forces," adds the defense of the former 'popular' treasurer, represented by the lawyer Marta Giménez-Cassina.

In this way, adds Bárcenas, "it is obvious" that by closing the investigations at this stage, "it is prevented from being able to prove the knowledge and participation of Mr. Rajoy in the facts under investigation." The former Prime Minister appears in the summary of 'Kitchen' alluded to on numerous occasions by the police commanders who intervened and at least two of them, Commissioners José Manuel Villarejo and Enrique García Castaño, have indicated that he was aware of what the The Anti-Corruption Prosecutor's Office considers a "para-police operation" to steal the documentation and recordings that Bárcenas hid and that allegedly incriminated the PP leadership.

The former treasurer of the PP also recalls that "the Public Prosecutor makes a detailed and detailed analysis" in his appeal "of the times in which the conversations between several of the intervening parties appear (in reference to the different police commands)". But he also emphasizes the references "from the agendas of Commissioner José Manuel Villarejo that work in cars such as 'El Asturiano' with clear reference to Mr. Rajoy."

In his appeal, Bárcenas also fights the decision of the investigating judge to leave the former secretary general of the PP, María Dolores de Cospedal, and her husband out of the investigation. "His interest in the development of 'Operation Kitchen' is derived from multiple evidence procedures carried out," he says. For what he calls "premature" the decision to remove them from the judicial process. "There are enough indications that lead us to think that the existence of the so-called 'political connection outside the Ministry of the Interior' in the 'Operation Kitchen' above the police leadership and the Ministry of the Interior". It, he emphasizes, "was essential for its effective realization."

In short, Bárcenas considers that "there is already more than enough circumstantial evidence that reveals that ('Kitchen') could not have been an isolated event carried out by a single individual with no organization behind it."

Therefore, it requests the reopening of the investigation, in line with what was claimed by the Anti-Corruption Prosecutor's Office in its appeal.
