September 17, 2021 The question posed by the Milan court for the medico-legal report on Silvio Berlusconi in the Ruby ter case "refers exclusively to the assessment of the health conditions of the interested party such as to allow active participation in the trial (. ..), ie not limited to the mere physical participation of the accused in the hearing, but also with regard to the inexistence of any obstacle to the effective articulation of a line of defense ". The president of the Milan court Roberto Bichi writes, explaining that "neither the defense nor the prosecutor have proposed observations on the expert question".

Former Prime Minister Silvio Berlusconi, in a statement filed with the president of the college, yesterday wrote that the decision of the Milan judges of the Ruby ter case to subject him to an "unlimited psychiatric examination" was "detrimental to his history and his integrity" , as well as an "obvious prejudice against him". Berlusconi explains that he "cannot therefore accept this decision", arguing that "in his absence, a trial will be held", which he defines as "unfair".
