The Abu Dhabi Court for Family and Civil and Administrative Claims obligated a young man to return the last amount of 1,000 dirhams transferred to him by the provider of the purchase of a dog. The court also ordered the defendant to pay the plaintiff an amount of 300 dirhams as compensation for the material and moral damages he sustained as a result of his failure to implement the agreement to sell the dog.

In the details, a young man filed a lawsuit in which he demanded to oblige another to return him an amount of 1,000 dirhams in addition to 500 dirhams in compensation, and oblige him to pay fees and expenses, noting that he had purchased a dog from the defendant and transferred an amount of 1,000 dirhams to him as an advance for the price of the dog, and when he went to receive the dog and paid The rest of the price, the defendant did not respond to, and enclosed in the lawsuit papers photos of conversations via “WhatsApp” and a photo of the deposit of 1000 dirhams in the defendant’s account.

For its part, the court stated, in the merits of the ruling, that according to Article 113 of the Civil Transactions Law, the creditor must prove his right and the debtor has to deny it, noting that the plaintiff provided evidence that he deposited an amount of 1000 dirhams in the defendant’s account, and it was confirmed from the attached correspondence that there was a negotiation to buy a dog, and the defendant did not appear before the court despite his announcement to make any payment or defense in the case, amount or substance, or dispute the reason for depositing the amount or the attached correspondence, with which the court obligates him to return the amount to the plaintiff.The court indicated that the request for material and moral compensation is from the court’s authority, and that it extracts the defendant’s mistake in taking the amount of 1000 dirhams from the plaintiff as an advance from the value of the dog that he offered for sale, and after receiving the amount, the plaintiff did not deliver the dog, and the defendant’s mistake caused the plaintiff some material and moral damages. The court considers with him that compensating the plaintiff for all material and moral damages is sufficient. The court ordered the defendant to pay the plaintiff an amount of 1,300 dirhams, and obligated the defendant to pay the fees and expenses of the lawsuit.
