The Constitutional Council approved, in large part, on Thursday the law concerning the extension of the health pass in the fight against the coronavirus.

Two measures were nevertheless censored.

Between the dismay of the restaurateurs and the victory of the unions, Europe 1 gathered the reactions of the main people affected by these restrictions. 

This decision was eagerly awaited.

Thursday, the Constitutional Council largely approved the law on the extension of the health pass and the vaccination obligation of certain professions.

He nevertheless rejects two government measures: compulsory isolation and the early termination of a CDD for unvaccinated people.

Restaurant owners will therefore have to apply the health pass from August 9.

The caregivers them, will have to be vaccinated under penalty of a suspension of salary.

"We are not immune to a major conflict with a client"

"How to do to fire someone? Me, I do not know how to do. I have forty-six years of work and I did not learn to do it. I learned to say welcome to people, to do in so that they are well at home ", deplores Alain Fontaine.

At the microphone of Europe 1 Thursday evening, the president of the French Association of Master Restorers describes the distress of his colleagues, who will have to check the health pass from August 9.

The Wise Men ruled on Wednesday: they consider that most of the measures which were contested by the opposition operate "a balanced conciliation". Clearly, balances are respected between health protection and respect for rights and freedoms. From August 9, you will therefore have to present your health pass - consisting of a PCR or antigen test of less than 48 hours or an anti-Covid vaccination - to access trains, shopping centers, bars or even hospitals.

"We are going to do everything to ensure that things go well. We are going to put the whole process in place. After that, we are not immune to a major conflict with a client who absolutely wants to enter our restaurant", s' worries Alain Fontaine.

And the health pass could also have serious consequences on turnover.

When it was introduced in cinemas on July 21, theaters had lost 70% of their usual attendance.

"I hope the same does not happen to us," he breathes. 

"The problem is not the vaccine"

As for the unions, the decision of the Wise Men is encouraging.

The Constitutional Council censured the termination of a fixed-term contract or an interim mission if the health pass is not validated, in professions where it is mandatory.

At the end of July, "we had contested the creation of a new reason for dismissal. It had been withdrawn as part of the debate in Parliament but there was still this problem of the termination of the contract for a fixed-term contract or a temporary employee", tells Yves Veyrier, the general secretary of Force Ouvrière, on Europe 1. This is no longer the case.

The Sages censured this measure in the name of equality between workers on permanent contracts and those with precarious contracts.

"However, it maintains the possibility of a suspension of the employment contract with suspension of remuneration. And that remains a heavy sanction for the employees", continues Yves Veyrier.

The general secretary of Force Ouvrière still assures us that "the problem is not the vaccine."

The trade unionist wants everyone to be able to get vaccinated quickly.

"But we must inform, reassure absolutely. And I do not believe that threatening is the right way to do things", continues Yves Veyrier.

The Prime Minister for his part congratulated Thursday evening on the decision of the Constitutional Council.

Jean Castex believes that it will allow the full deployment of the strategy to fight against the coronavirus.
